The disposal of or dumping of any garbage, food waste, human excrement,
wastewater or any other waste or sewage material into any of the waterways,
lakes, ponds or streams within the Township of Middle is hereby prohibited.
Living upon, cooking, using toilet facilities or disposing of any garbage,
food waste, human excrement, wastewater or any other waste or sewage material
on or from any boat, barge or other vessel docked in or moored in or passing
over the waterways within the Township of Middle is hereby prohibited unless
a written permit is first obtained from the Chief of Police.
Before any permit is issued by the Chief of Police, an inspection must
be made by either the Chief of Police or other senior police official or the
Harbor Master or the duly authorized representative of the Board of Health
of the Township of Middle. Such inspection must be followed by a written report
describing the facilities available on the subject boat, barge or other vessel
to prevent pollution of the waterways. If the Chief of Police is satisfied,
based upon said inspection and written report, that a person or persons can
live upon, cook or use the toilet facilities of the subject boat, barge or
other vessel without polluting the waterways of the Township of Middle, then
the Chief of Police may issue a permit authorizing a person or persons to
live upon, cook or use toilet facilities on the subject boat, barge or other
vessel; provided, however, that such permit shall not, under any circumstance,
authorize the holder thereof to pollute the waterways of the Township of Middle.
The position of Harbor Master is hereby created. The Harbor Master shall
be appointed by the Township Committee for a term not to exceed one year,
and the Harbor Master's term of office shall expire on December 31 annually.
The Harbor Master's duties shall include the enforcement of this chapter,
and the Harbor Master shall perform such other duties as are authorized by
the laws of the United States of America and the State of New Jersey and such
other duties as may be prescribed from time to time by resolution or ordinance
of the Township of Middle.
All members of the Police Department of the Township of Middle, the
New Jersey State Police and the New Jersey Marine Police, as well as the United
States Coast Guard and all other law enforcement officers and health officers,
are authorized and empowered to enforce this chapter.
The violation of any of the provisions of this chapter shall, upon conviction,
be punishable by one or more of the following: imprisonment not to exceed
90 days or a fine not to exceed $1,000 or a period of community service not
to exceed 90 days. Each twenty-four-hour period that any violation continues
to exist shall be deemed to be a separate offense and shall be punishable
as aforesaid.
