For the purposes of this article, the following
terms shall have the meanings indicated:
STREET
Includes one or more streets, avenues, lanes, roads, boulevards,
parkways, viaducts, alleys or highways intended for use by the public.
In the event that a new street is to be constructed
within the limits of the Borough with a view to its being accepted
for use by the public, the person (hereinafter referred to as the
"developer") owning the land upon which such street is to be constructed
shall submit to the Council, before work is started, a comprehensive
plan prepared by a licensed professional engineer or land surveyor
of the state.
The comprehensive plan required by this article
shall show the outline of the entire property to be subdivided, the
locations and widths of proposed streets and the locations and widths
of existing connecting streets.
The comprehensive plan required by this article
shall conform in all respects with an act which may be cited as the
Map Filing Law, N.J.S.A. 46:23-9.7 et seq.
A separate map showing the plan and profiles of proposed streets, the tentative location of necessary sanitary and storm sewers, waterlines, curbs, catch basins, manholes and other utilities shall also be filed with the comprehensive plan required in §
217-29. The horizontal scale of such map shall be one inch to 50 feet, and the vertical scale shall be one inch to five feet.
The approval of a plan required by this article
by the Council shall in no way be considered as an acceptance of any
street nor shall such approval obligate the Council to maintain or
exercise jurisdiction over such street.
Sanitary sewers, drainage structures, water
mains and service lines, gas mains and service lines must all be installed
prior to construction of roadway pavements. Trenches which have been
opened for that purpose shall have been backfilled and thoroughly
compacted.
In constructing new streets, easements of a
width sufficient to allow proper maintenance shall be provided for
the outletting of all drains, pipelines, etc., to streams, existing
storm drains or other legal drainage courses. These easements shall
be granted to the Borough by approved legal procedures.
No dead-end street more than 500 feet long will
be permitted, and, where permitted, a turnaround with a radius not
less than 50 feet shall be provided at the dead end.
No new street shall be approved which has a
right-of-way less than 50 feet in width.
Before the acceptance of any new street by the
Council, the developer shall post a maintenance bond with the Borough
Clerk. The bond shall name the Borough as obligee and shall, in addition
to the developer, be entered into by such surety as may be acceptable
to the Council. The bond shall secure the Borough against maintenance
of the street to be accepted for a period of two years from the date
of acceptance and shall be in such amount as may be required upon
the recommendation of the Borough Engineer.
All construction work on new streets shall be
done under the supervision of the Council, and the developer shall
pay for the cost of inspection when necessary.
A. All materials and appurtenances used in the construction
of new streets, unless otherwise specified in this article, shall
comply with the requirements set forth in the current specifications
of the State Highway Department.
B. Delivery tickets for all materials used in the construction
of roads shall be turned over to a representative of the Council for
tabulation and inspection. When, in the opinion of the Council, there
is any question as to the quality of any material used in the construction,
such material shall be tested by an approved testing laboratory at
the expense of the developer.
In constructing new streets, all topsoil shall
be stripped from the proposed roadway for its entire width, and the
subgrade, when completed, shall conform to the line, grade and cross
section shown on approved plans. After the subgrade has been shaped,
it shall be brought to a firm, unyielding surface by rolling the entire
area. All soft spongy material shall be removed from the area and
replaced by broken stone, slag, gravel or acceptable earth. All loose
rock or boulders shall be removed or broken off six inches below the
surface of the subgrade. All stumps, logs or other materials which
may decompose shall be removed in their entirety.
In constructing new streets, embankments shall be formed of suitable material placed in successive layers of not more than 12 inches in depth for the full width of the cross section and shall be compacted by distributing the necessary hauling uniformly over the preceding layer and by rolling as directed in §
217-41. No stumps, trees, rubbish or other material which may decompose shall be permitted in the fill.
Satisfactory provisions shall be made for the
removal of surface drainage from new streets as well as from abutting
property and in no case shall surface water be permitted to run more
than 1,000 feet along the street before reaching a watercourse or
inlet. The size, location and depth of storm sewers shall be approved
by the Borough Engineer.
After the subgrade of new streets has been approved
by the proper authorities and utilities are completed, the macadam
base course shall be constructed of two-and-one-half-inch stone rolled
to a minimum thickness of four inches. After the stone has been properly
rolled, stone dust shall be spread over the surface and worked into
the voids. The dust shall be applied in thin layers with intermittent
rolling between each application. After completion of the rolling,
the entire base course shall be broomed and swept so that no surplus
dust remains on the surface. Spots that have become loose, raveled
or rutted shall be repaired and rerolled.
After the foundation course of a new street has been prepared as specified in §
217-44, there shall be spread over its surface a uniform layer of clean one-and-one-half-inch stone, which, when compacted, shall have a uniform thickness of three inches and have the proper crown and grade.
A bituminous binder of tar, grade Rt-11 or Rt-12,
or asphaltic oil, grade OA-4, NA-4 or T-4, shall be applied when constructing
a new street from an approved pressure distributor, at the rate of
1.8 to two gallons per square yard. The amount of bitumen is based
on a temperature of 60º F. No bituminous binder shall be applied
when the atmospheric temperature is below 50º F. or when the
temperature during the preceding eight hours has been below 50º
F. The stone for its full depth shall be dry, and other conditions
shall be such that a satisfactory penetration and adhesion of the
bitumen to the stone will be secured when the bitumen is applied.
The bitumen, when applied, shall have a temperature of between 300º
and 350º F. if asphalt and between 185º and 250º F.
if tar. When the atmospheric temperature is between 50º and 65º
F., asphalt shall be not less than 325º F. and tar shall be not
less than 225º F. If weather conditions are not favorable or
if the atmospheric temperature is less than 50º F., no bitumen
shall be applied. Immediately after the first application of bitumen,
there shall be spread a uniform layer of five-eighths-inch crushed
stone (approximately 60 pounds per square yard), which shall be applied
so as to completely fill the surface voids in the one-and-one-half-inch
stone. Immediately after the stone has been spread, the surface shall
be rolled until the five-eighths-inch stone is firmly inbedded in
the bitumen.
Immediately after the rolling required in §
217-46 has been completed, a second coat of bitumen shall be applied at the rate of 1/2 to 3/4 gallons per square yard. While the bitumen is still hot, the surface shall be covered with a layer of three-eighths-inch stone and rolling continued until the road surface has the required density, crown and grade. After being rolled, the road may be thrown open to travel. If the bitumen is forced or drawn to the surface, additional stone must be applied at all such places in sufficient quantity to keep the entire road surface covered. If, during the application of the bitumen or any time thereafter, any places are discovered that appear deficient in bitumen or that are not properly coated or bound together, additional bitumen must be applied and covered with stone and rerolled as before specified. The finished surface must be free from spots that appear porous, have an excess of screenings, are not properly rolled or consolidated or do not have the required crown.
At such a time as approved by the Council, which
time shall be not less than 30 days after the second application,
the pavement of a new street shall be swept thoroughly and all dust
and dirt removed. Asphaltic oil, grade RCO or RC 2, or tar, grade
RT-7 or RT-8, shall be applied from an approved pressure distributor
at the rate of not less than 1/3 gallon per square yard. Grade
A screenings shall be applied over the surface in sufficient quantity
to completely cover the bituminous material (approximately 25 pounds
per square yard). The surface shall then be rolled, after which the
road may be opened to traffic.
All driveways from the house to the street shall
be constructed in such a manner as not to interfere with the flow
of water in the street or drainage ditches along the public street.
Before acceptance of any new street by the Council,
an affidavit shall be made by the developer certifying that all costs
incurred in the construction of the improvement have been paid.
