This article shall be known as "The Village of Akron Dog Licensing and Dog Control Law."
In response to the New York State Department of Agriculture and Markets' delegation of licensing duties to local municipalities, the Village of Akron shall adopt, with specific exceptions as enumerated herein, the Town of Newstead Dog Licensing Law Chapter 114, except as specified and excepted herein. This article is adopted for the promotion of the public welfare and general welfare of the community, including the protection and preservation of the property of the Village of Akron and all its inhabitants and of peace and good order by controlling and regulating dogs in the Village of Akron. The Village of Akron hereby designates the Town of Newstead as the proper licensing authority, for the collection of fees and distribution of tags, for the dog owners residing within the Village.

A. 
All references to the Town of Newstead shall be understood to include the Village of Akron. All references to the Town of Newstead Dog Licensing Law shall be understood to be the Local Law 1 of the Year 2015 of the Town of Newstead.
B. 
Notwithstanding any provision to the contrary in the Town of Newstead Dog Licensing Law, the maximum number of dogs, over the age of four months, allowed to be harbored on any parcel of land is three. Notwithstanding the forgoing, the maximum number of individuals dogs (of any age) which shall be permitted to be harbored on any given parcel, regardless of the purpose or the duration of the stay at said parcel, shall be 15 dogs per calendar year.
C. 
Persons, who, at the time of adoption of this article shall have more than three dogs on any parcel of land within the Village of Akron shall be allowed to maintain said dogs, however, upon the loss of such dog by death, sale or other transfer, said persons may not replace if the total number of dogs on said parcel will be more than three.
D. 
As changes or updates are made to the Town of Newstead Dog Licensing Law, the Village of Akron shall review for possible adoption and amendment to this article.
E. 
Kennels shall be allowed pursuant to special permit application.
F. 
No owner or person in charge of a dog, cat or other pet animal shall permit it to run at large (remain outside an area of escape such as a pen, corral, yard, cage, house, vehicle or other secure enclosure, unless otherwise directly under appropriate human control) or to commit any nuisance within the limits of the Village.
G. 
An animal shall become a nuisance whenever it shall engage in or commit any of the following within the confines of the Village: injure or threaten injury to persons or other domestic animals or birds; injure property, including lawns, flowers, shrubs, or trees; upset or otherwise interfere with garbage receptacles; be found in any commercial establishment without the consent or permission of the owner thereof; be kept or placed by its owner under cruel, unsanitary, or otherwise inhumane conditions or be abandoned by its owner; defecate, urinate, dig or otherwise damage property other than the property of the owner; or engage in loud or habitual barking, crying, or whining or conduct itself in such a manner as to unreasonably and habitually disturb the comfort or repose of any person other than the owner of such animal.
H. 
Any person who shall be convicted of violating any provision of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty.
The purpose of this section is to specifically except all sections of the Town of Newstead Dog Licensing law which allow for the licensing at any parcel of more than three dogs. The following sections are specifically excepted herefrom:
A. 
Section 114-2F, Purebred license.
B. 
Section 114-2I, Multi-dog permits.
C. 
Section 114-2I(2), Kennels.
