Act 60 of 1995 of the Commonwealth of Pennsylvania known as "the Second Class Township Code" provides in Section 606 thereof for the compensation of Township Supervisors and, further, provides therein that Supervisors of Townships having a population between 5,000 to 9,999 may be compensated in an amount not to exceed $2,500 per annum. The population of East Whiteland Township according to the most recent official census is 8,588.

Said Act authorizes the Board of Supervisors to set the compensation of Supervisors subject to the limitations set forth in the Act, and subject to the constitutional and public policy limitations of the Commonwealth which precludes application of an ordinance increasing elected officials' compensation to those elected officials serving a term of office at the time the ordinance is adopted, unless they have been elected to a new term of office commencing after the effective date of the ordinance.
Beginning January 1, 1998, any East Whiteland Township Supervisor elected, re-elected or appointed to office on or after November 4, 1997, shall receive compensation as a Supervisor in the annual sum of $2,500, payable quarterly.
Supervisors elected, re-elected or appointed to office after the effective date of Ordinance No. 77-85, as amended, but before November 4, 1997, shall continue to receive annual compensation in the amount therein provided for, subject to their right to such greater compensation as provided for herein upon their re-election to office subsequent to the effective date hereof.
Ordinance No. 77-85, as amended, is amended only to the extent provided for herein; otherwise, it shall remain in full force and effect.
