A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
ENGINE BRAKE RETARDING DEVICE
Any mechanical, electromechanical, or electronic mechanical device, or any combination thereof (also commonly called an "engine brake"), used for the purpose of supplementing the braking system of a diesel-, gasoline-, or propane-powered motor vehicle engine.
PHOENIXVILLE PIKE
A portion of a former state highway, which, within the municipal limits of East Whiteland Township, is owned and maintained by East Whiteland Township.
B. 
Prohibition of the use of engine brake retarding devices. No operator of any gasoline-, diesel-, or propane-powered motor vehicle shall engage, use or otherwise operate an engine brake retarding device on the following roads within the municipal limits of East Whiteland Township. This prohibition shall not apply to emergency situations requiring the use of an engine brake retarding device, provided the emergency situation presents a clear and present danger to the safety and/or property of persons within the municipal limits of East Whiteland Township, other motor vehicle operators, and the operator and/or passengers of the motor vehicle utilizing the engine brake retarding device in the emergency situation.

Violations and penalties. Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of not less than $300 nor more than $600, plus costs of prosecution, and such other costs as may be authorized by the Commonwealth of Pennsylvania.
It shall be unlawful for any person to drive any vehicle, except a passenger vehicle (but not including any passenger vehicle drawing any trailer or towing any other vehicle), upon any of the streets or parts of streets described below.
