As used in this article, the following terms shall have the meanings indicated:
ABANDONED VEHICLE
As defined by the Pennsylvania Vehicle Code.
PARK and PARKED
The halting of a vehicle, whether occupied or not, except momentarily for the purpose of and while actually engaged in loading or unloading property or passengers.
PERSON
Any individual, person, firm, corporation, association or other entity.
PUBLIC ROAD
Any street, highway, lane or drive maintained by East Whiteland Township as a public roadway.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway or any device which may be drawn upon a highway. A vehicle shall include, but not be limited to, a bus, trailer, mobile home, tractor, motorcycle, passenger car, snowmobile, truck camper, construction equipment, special mobile equipment as defined by the Pennsylvania Vehicle Code or any equipment requiring registration or licensing by the Pennsylvania Department of Transportation.

A. 
There shall be no parking of any motor vehicle, trailer, boat or camper on any public roadway within East Whiteland Township at any time from the beginning of the accumulation of any frozen precipitation (snow or ice) until the precipitation stops and the roadway is cleared by the East Whiteland Township Public Works Department. If a property owner has no alternative location to park his/her vehicle during the time period when motor vehicles are not permitted to be parked on the public roadways, he/she may park the vehicle in designated areas in the Township Building parking lot.

Following the cessation of any such precipitation, no vehicle shall be parked on any public roadway until it has been completely plowed, cindered and salted for the full width of the paved cartway. This article shall be construed so that no portion of any vehicle shall protrude on or be upon the berm or paved cartway of a public road during the prohibited parking period. If a property owner has no alternative location to park his/her vehicle during the time period when motor vehicles are not permitted to be parked on the public roadways, he/she may park the vehicle in designated areas in the Township Building parking lot.

Any person who violates or permits the violation of any provision of this article shall, upon conviction thereof in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense, and shall be subject to the payment of a fine in the amount of $25 plus the costs of prosecution. Each provision of this chapter that is violated and each day or part thereof during which a vehicle remains on a public road or private road in violation of this article shall constitute a separate offense, each of which violations shall be punishable by a separate fine imposed by the District Justice of $25, plus the costs of prosecution. All fines and penalties collected for violation of this chapter shall be paid to the Township Treasurer.
Any police officer may remove or cause to be removed to a place of safety any unattended or illegally parked vehicle left standing upon any public road or private road during any period prohibited by this article when the vehicle is in such a position as to interfere with municipal snow removal, cindering and salting operations. The procedures in Article IV of this chapter shall govern removal of vehicles.
This article is applicable to any private road which the East Whiteland Township Board of Supervisors chooses to serve pursuant to recognition of special conditions giving rise to concern for the public health, safety and welfare. The decision to maintain such private road shall be within the sole discretion of the Township and pursuant to request by a legal owner of record of the property. Such service shall be provided as a courtesy to affected residents of the Township, and the Township shall incur no legal obligations by virtue of its providing such a service prior to the dedication of any affected roadway. On these private roads, the Township may enforce this article in the same manner as on public roads.
