The Township of Lower Saucon shall continue as a municipal corporation with the power to perform and exercise any power or function not denied it by the Constitution of the United States, by the Constitution of the Commonwealth of Pennsylvania, by the General Assembly or by its Council-Manager optional plan form of government.[1]

The grant of municipal powers under the Home Rule and Optional Plans Law, Act 62 of 1972, P.L. 184, as amended,[1] provides that such powers, whether in the form of specific enumeration or general terms, shall be liberally construed in favor of the Township. Specific mention of particular powers in the Council-Manager plan shall not be construed as limiting in any way the general powers stated in § 5-4 above.

Since the Council-Manager optional plan[1] does not provide for specific and detailed provisions for the administrative structure and governmental procedure, this administrative code shall provide such specific enumeration on all matters, not inconsistent with the Home Rule Charter and Optional Plans Law,[2] which the needs of a flexible organization require.

The form of the administrative code shall be a compilation of ordinances consistent with the provisions, spirit and purpose of the Home Rule Charter and Optional Plans Law.[1] The administrative code shall be drafted by the Transition Committee and presented to the Council for its review and consideration. The Council shall adopt, by ordinance, an administrative code which shall provide for the establishment and filling of additional administrative offices which it shall deem necessary and shall provide for administrative procedures not otherwise provided for in Act 62,[2] or by general law.
