The purpose of this article is to regulate and restrict the parking of vehicles on public roads within the control and limits of the Town of Killingworth, during a period of snow emergency, so as to assure the removal of snow and the provisions of the transportation and movement of food, fuel, medical care, fire, health, police protection and other vital facilities of the Town.
A snow emergency is defined to be a period of time before, as forecast by the United States Weather Bureau, during or after a fall of snow, sleet or freezing rain, during which period vehicular and pedestrian traffic is expected to be hazardous or congested due to the elements, and during which period the parking of vehicles could hinder, delay or obstruct the safe flow of such traffic and the proper cleaning, clearing and making safe of the public roads of the Town.
A. 
A snow emergency shall be declared by the First Selectman either before, during or after a fall of snow, sleet or freezing rain, when in the First Selectman's sound judgment and discretion the circumstances warrant the determination that such an emergency is in the interest of safety upon the public roads of the Town.
B. 
The First Selectman shall cause a snow emergency declaration pursuant to this section to be publicly announced. Such public announcement shall include the time the snow emergency declaration became or will become effective.
It shall be unlawful at any time during the period of any snow emergency for the owner or operator of a vehicle to park or permit such vehicle to remain parked on any public road.
From November 15 to April 15 of each year, it shall be unlawful during the hours of 12:00 midnight to 6:00 a.m. for the owner or operator of a vehicle to park or permit such vehicle to remain parked on any public road.

A. 
Parking in violation of this article shall be punishable by a fine of $50 for the first violation. The fine for each subsequent violation will increase by $50. The maximum fine is $250.
B. 
The owner or operator of any vehicle parked in violation of this article shall also be liable to the Town for any towing and storage fees which may be incurred under § 436-7A of this article.
A. 
Any vehicle which is parked in violation of this article shall be issued a parking violation tag and the vehicle shall be towed at the expense of the registered owner of the vehicle parked in violation of this article. The registered owner of the vehicle shall be deemed liable for all monetary and legal charges levied in Connecticut with the violation, towing and storage of the vehicle. The First Selectman or his designee, police officer or supervisor in charge of snow plowing is authorized to tag and have removed any vehicle found to be in violation of this article and to cause it to be placed in storage.
B. 
The owner or operator of an impounded vehicle shall present evidence of identity and right of possession of the vehicle before being allowed to recover it, and shall sign a receipt for its return, and shall pay the fine, the cost of towing and all costs of storage accrued.
C. 
It shall be the duty of the First Selectman to keep a record of each vehicle removed in accordance with this section. The record shall include a description of the vehicle, its license number, the date and time of its removal, where it was removed from, the name and address of its owner or last operator (if known), the parking violation involved and its final disposition.
D. 
The Town may contract with any person or private company which the Board of Selectmen shall deem qualified to provide such towing and storage services to the municipality as it may require. Such person or private company shall provide the municipality with casualty loss and liability insurance in such an amount as the Board of Selectmen deems appropriate to adequately indemnify such municipality from claims against it for damages incurred.
In any enforcement hereunder, the registered owner of any such vehicle shall prima facie be presumed to have parked or to have authorized the parking of said vehicle in violation of this article.

No person shall deposit or permit to be deposited snow or ice from his or her premises, driveways, or sidewalk in front of his or her premises upon public roads.
B. 
Any person in violation of Subsection A of this section shall be fined $50 for the first violation. The fine for subsequent violations will be increased by $50. The maximum fine is $250.

C. 
This section shall be enforced regardless if a snow emergency has been declared.
