The purpose of this article is to regulate the
hours of construction and the use of power equipment out of doors
in order to protect and promote the health, safety and welfare of
the public in the Borough of Chatham.
The activities restricted by this chapter shall
be permitted only during the following hours:
A. Weekdays: 8:00 a.m. to 7:00 p.m.
B. Saturdays: 9:00 a.m. to 6:00 p.m.
C. Sundays or federal holidays: 9:00 a.m. to 6:00 p.m.
by occupants of the premises only.
The restrictions of this chapter shall not apply
to the following:
A. Activities confined within a wholly enclosed building
or structure.
B. Activities conducted pursuant to and within the terms
of a permit issued by the Borough Administrator where he finds the
public welfare will be enhanced by the work or will be harmed by the
failure to perform the work at the times indicated therein.
C. Activities necessary to prevent injury to persons
or property, including snow removal.
D. Activities conducted by or for any government unit
or agency.
The Construction Code Official or his authorized representative and the Chatham Borough Police Department are hereby authorized to enforce the provisions of this Article

Any person failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable as provided in Chapter
1, §
1-14. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
If any section, sentence or provision of this article is adjudged unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remainder of this Article
