The Township Committee has found that there are located within its boundaries
many private land uses which serve the general public or a significant, though
select, group of persons. The life, health, safety and general welfare of
the users of such facilities are endangered when, as a result of prolonged
or severe ice and snow conditions, unobstructed access to the premises is
limited beyond a reasonable time.
As used in this chapter, the following terms shall have the meanings
indicated:
INTERIOR ROADWAY
The internal access system for motor vehicles serving a property,
whether or not such system complies with municipal specifications for a road
or accessway and whether or not it is designated as other than a road on any
official document.
OFF-STREET PARKING AREAS
That area providing off-street parking spaces and off-street areas
providing access thereto for the general public or a significant, though select,
group of persons and including sidewalks and off-street parking, loading and/or
unloading areas for vehicles servicing establishments.
It shall be the obligation of every owner of a land use hereafter defined
to maintain the interior roadway and parking area upon his premises in a condition
free from snow and ice.
The owners of the following categories of land uses shall be subject
to the requirements of this chapter:
A. Apartment complexes containing an interior roadway, the
length of which exceeds 500 feet measured along the center line of said system,
or containing 25 individual residential units.
B. Industrial parks, factories, offices, shopping centers
and places of business which contain interior roadways and/or off-street parking
areas.
C. Townhouse developments and other developments containing
multifamily units.

D. Streets within major subdivisions involving three or
more lots, where one or more single-family dwellings have been constructed
and are occupied pursuant to a permanent or temporary certificate of occupancy
issued by the Township of Hampton, until the street or streets furnishing
access to the dwelling or dwellings have been accepted by the Township of
Hampton.

All interior roadways and off-street parking areas shall be cleared
of snow and ice within eight hours of daylight after the same shall fall or
be formed thereon. In the event that ice may be so frozen as to make removal
impractical, the owner shall cause said areas to be thoroughly covered with
sand, ashes, sawdust or rock salt so as to maintain said areas in a safe condition.

This chapter shall be enforced by the Construction Official and/or the
Township Road Supervisor.
It shall be unlawful for any person to remove snow or ice from any private
property, other than a public sidewalk, and place the same onto the sidewalk
or roadway of any street.
If any section, paragraph, subdivision, clause or provision of this
chapter shall be adjudged by the courts to be invalid, such adjudication shall
apply only to the section, paragraph, subdivision, clause or provision so
adjudged, and the remainder of this chapter shall be deemed valid and effective.
Any person, firm or corporation violating this chapter or any of its
provisions shall, upon conviction thereof, pay a penalty of not less than
$2 nor more than $500 for each violation, and, for a continuing violation,
each day shall constitute a separate offense.
This chapter shall be in full force and effect immediately upon its
adoption and its publication as provided by law.
