In order to carry out its mandated functions in the administration of its ordinances, laws and regulations relating to construction and development, the Town of Greenburgh incurs expenses. These expenses include but are not limited to the cost of preparing technical reports, inspection reports and documentation. Further, the Town is empowered by law to impose various charges upon applicants for the purpose of assuring that it will be reimbursed for the expenses incurred in processing such applications.
The following fee schedules are hereby adopted:
A. 
Application for site plan approval pursuant to the Code of the Town of Greenburgh: $100, plus $3 per each required off-street parking space; if a public hearing is required: $50 for publishing legal notices. In no event shall the total fee exceed $1,000 for each application filed.
B. 
Application for special permit pursuant to Chapter 285 of the Code of the Town of Greenburgh: $100, plus $3 per each required off-street parking space.
C. 
All other applications made to the Zoning Board of Appeals pursuant to Chapter 285 of the Code of the Town of Greenburgh: $50.
D. 
Application for amendment to Zoning Ordinance[1]or Zoning Map: $300.

E. 
Application for preliminary subdivision approval pursuant to Chapter 250 of the Code of the Town of Greenburgh:
(1) 
For a subdivision creating a new road or roads: $150, plus $30 per lot shown on the preliminary plat.
(2) 
For a subdivision without a new road: $100, plus $15 per lot shown on the proposed subdivision plat.
F. 
Application for final subdivision approval pursuant to Chapter 250 of the Code of the Town of Greenburgh:
(1) 
For a subdivision creating a new road or roads: $50, plus $15 per lot shown on the proposed final plat.
(2) 
For a subdivision without a new road: $30, plus $15 per lot shown on the proposed final plat.
(3) 
In the event that a public hearing is required: $50 for publishing the legal notice.
G. 
Application for a tree removal permit pursuant to Chapter 260 of the Code of the Town of Greenburgh: $10.
H. 
Application for a freshwater wetlands permit pursuant to Chapter 280 of the Code of the Town of Greenburgh: $50.
I. 
Applications under the Environmental Quality Review Law pursuant to Chapter 200 of the Code of the Town of Greenburgh:
(1) 
Pursuant to § 200-7: a minimum fee of $25, but not to exceed 1/10 of 1% of the total estimated cost of the proposed action, plus the costs of publication, may be charged to the applicant.
(2) 
Pursuant to § 200-10: a minimum fee of $100, but not to exceed 3/10 of 1% of the total estimated cost of the proposed action, plus the costs of publication, may be charged to the applicant.

Pursuant to § 200-12: a minimum fee of $100, but not to exceed 1/10 of 1% of the total estimated cost of the proposed action, plus the costs of publication, may be charged to the applicant.

J. 
Application for large-scale development pursuant to the applicable provisions of the Zoning Ordinance[2] or the Code of the Town of Greenburgh, as the case may be: $100.

K. 
Application for a Planned Unit Development District (PUD), pursuant to the 1980 Town of Greenburgh Zoning Ordinance, § 285-24: $300, plus $3 per each required off-street parking space.

L. 
Application for a steep slopes permit pursuant to Chapter 245 of the Code of the Town of Greenburgh: 1/2% of the first $5,000,000 of project construction costs and 1/10% of that portion of the project construction costs that exceeds $5,000,000.

M. 
Application for a stormwater management control permit pursuant to Chapter 248 of the Code of the Town of Greenburgh: 1/2% of the first $5,000,000 of project construction costs and 1/10% of that portion of the project construction costs that exceeds $5,000,000.

N. 
Whenever a project requires both a stormwater management control permit and a steep slopes permit, the applicant shall only be required to pay the fee for the stormwater management control permit, as defined in Subsection M referenced above.

With the exception of fees pursuant to Chapter 200, the Environmental Quality Review Law, of the Code of the Town of Greenburgh, no fees pursuant to this chapter shall be required to be paid by the state or any of its authorized agencies, the county or any of its authorized agencies, the Town or any school districts, any fire districts or any village located within the Town.
A. 
All fees in connection with applications to the Building Department shall be collected by the Building Inspector.
B. 
All fees in connection with applications to the Zoning Board of Appeals shall be collected by the Secretary of the Zoning Board of Appeals.
C. 
All fees in connection with applications to the Planning Board or Planning Director shall be collected by the Secretary of the Planning Board.
D. 
All fees collected in connection with applications for zoning amendments shall be collected by the Town Clerk.
E. 
In addition to the fee schedules set forth in § 230-2 of this chapter, the costs of publication of legal notices may be collected by the applicable public official pursuant to this section.

This chapter shall not be affected by any other ordinances or laws or parts of ordinances or laws heretofore enacted by the Town Board of the Town of Greenburgh in conflict or inconsistent with any provision of this chapter.
