It is the legislative intent of the Town Board to clarify, by this chapter, the structure, functions and duties of the Department of the Comptroller so as to permit and foster the orderly operation of the financial and administrative functions and responsibilities of the government of the Town of Greenburgh.
There is hereby established for the Town of Greenburgh a Department of the Comptroller, hereinafter called the "Department."
The principal executive officer and administrative head of the Department shall be the Comptroller, who shall be appointed by the Town Board for a term of two years and at such salary as may from time to time be fixed by the Town Board. The Comptroller shall be appointed on the basis of administrative experience and qualifications for the duties of such office and such additional standards as may be required by the Town Board. The Comptroller shall be the head of the Department, with power and authority to appoint and remove employees under his jurisdiction, in accordance with the Civil Service Law.
There shall be a Deputy Comptroller, who shall have such powers and duties as are prescribed by the Comptroller and who shall generally act for and in place of the Comptroller. The Deputy Comptroller shall be appointed by the Town Board for a term of two years and at such salary as may from time to time be fixed by the Town Board.
A. 
The Comptroller shall have such powers as shall be necessary for the proper administration of the Department, consistent with applicable provisions of law.
B. 
The Department shall include, in addition to its other functions, the following divisions under the control and direction of the Comptroller as follows:
(1) 
Personnel Administration. The Town Comptroller shall administer and coordinate all aspects of personnel management for all departments of the Town of Greenburgh so as to assure compliance with the Civil Service Law, the rules and regulations of the Westchester County Department of Personnel and any other applicable law or ordinances and administer for all departments of the Town of Greenburgh the applicable health insurance programs, worker's compensation insurance, claims, affirmative action, equal opportunity programs, labor contracts and employee assistance programs. Nothing herein shall be construed to authorize the Town Comptroller to appoint or remove any officer or employee outside of the Comptroller's Department. All officers and employees of the Town shall be appointed or removed by the Commissioner or administrative head of the respective department if provided by appropriate local law or else shall be appointed or removed by the Town Board. No Commissioner or administrative head of any department shall appoint or remove any employee without a determination by the Town Comptroller that said appointment or removal is in compliance with all applicable civil service laws, rules and regulations. Appeals on any such determination may be made to the Town Attorney.
(2) 
Printing and Reproduction. The Town Comptroller shall administer mail room, printing, reproduction and messenger service for all departments of the Town of Greenburgh.
(3) 
Data Processing. The Town Comptroller shall administer and coordinate all aspects of data processing for all departments of the Town of Greenburgh, except all aspects of data processing handled separately by the Data Processing Unit of the Greenburgh Police Department.
A. 
The powers and duties of the divisions of the Department shall be under the administrative direction and control of the Comptroller.
B. 
The Comptroller shall be empowered to perform such other duties and functions that are prescribed to be performed by him by statute or by any law, ordinance or resolution of the Town Board or lawful direction of the Supervisor.
Nothing herein contained shall be construed to delegate or transfer any power of the Town Supervisor contained in §§ 29, 52 and 125 of the Town Law of the State of New York or any other powers which may lawfully be exercised by said Supervisor.
The Comptroller may establish, subject to Town Board approval, a schedule of fees to be collected by him for services rendered in connection with the work of the Department and for which he deems it necessary to charge and to collect a fee therefor.
