This chapter shall be known as "Games of Chance in the Village of Penn Yan."

Authorized organizations may, upon obtaining a license from the Village Clerk, conduct games of chance within the Village of Penn Yan as provided in Article 9-A of the General Municipal Law and as provided further in this chapter. Such games of chance will be conducted in accordance with the laws of the State of New York and with the rules and regulations adopted by the New York State Gaming Commission and pursuant to this chapter.
The conduct of games of chance shall be subject to the restrictions imposed by § 189 of the General Municipal Law.
The Chief of Police of the Penn Yan Police Department shall exercise control over and supervision of all games of chance conducted under a duly authorized license. The Chief of Police shall have all those powers and duties set forth in and for the enforcement of Article 9-A of the General Municipal Law.
This chapter shall take effect immediately upon filing with the office of the Secretary of State, following its approval by a majority of the qualified voters of the Village of Penn Yan voting on a proposition therefor at a general election held pursuant to the provisions of § 23 of the Municipal Home Rule Law.[1]
