This chapter shall be known and may be cited as the "Outdoor Fire Ordinance
of the Town of Pound Ridge."
This chapter applies throughout the Town of Pound Ridge, New York. It
prescribes regulations governing outdoor burning and the mechanism for enforcement
thereof, in order to safeguard life and property from the hazards of fire.
Unless otherwise stated, the following terms shall respectively have
the following meanings:
ADEQUATE INCINERATOR
Any steel, cast-iron, masonry or wire receptacle with solid or perforated
sides, fronts and backs (any such perforations not exceeding one inch on a
side or in diameter), equipped with a spark arrestor or cover sufficient to
prevent the escape of sparks or embers, with no openings or perforations exceeding
one inch on a side or in diameter and with any draft doors or other openings
protected with a one-inch-mesh wire screen or equivalent.
BURNING
Includes any fire in an adequate incinerator and any uncontained
fire, including, without limitation, the combustion of materials for cooking,
heating, illumination or destruction.
PERSON
Includes an individual, partnership, corporation or other legal entity.
UNCONTAINED FIRE
Any outdoor fire not in an adequate incinerator (including, without
limitation, bonfires, campfires, fires set for the purpose of clearing land,
destroying plants, animals, insects, rubbish or other waste materials and
fires set for any other purpose).
This chapter shall not, and shall not be construed to, make the Town
responsible for any damage to persons or property by reason of any inspection
authorized herein or failure to inspect or by reason of the approval or disapproval
of any equipment authorized herein, or for any other reason.
All outdoor burning in the Town of Pound Ridge may be prohibited by
the fire inspector when he deems that the public safety of the Town may be jeopardized
by outdoor fires. In the event of the failure of the fire inspector to so
act, such authority may be exercised by the Supervisor or the Town Board.
