Attachment 1 - Scotts Corners Parking Plan

The purpose of this article shall be to:
A. 
Organize public parking to balance the satisfaction of the needs of the several interested parties and users within the Business District;
B. 
Efficiently allocate public parking resources so as to provide, to the extent practicable, proper parking in proximity to users, residences and establishments in need of such parking;
C. 
Provide all economical maintenance of the public parking facilities, including, without limitation, repairs, cleaning and snow removal.
For the purposes of these regulations, the following definitions shall be applied.
PARK or PARKING
The act or process of leaving a vehicle unattended (without its driver or operator), other than temporarily for the purposes of, and while actually engaged in, receiving or discharging passengers or in obedience of traffic regulations, signs or signals, or an involuntary stopping of the vehicle by reason of causes beyond the control of the operator.
PARKING SPACE
A plot or area delineated by painted stripes and signage for the purposes of parking a vehicle.
VEHICLE
Any self-propelled powered device or mechanical conveyance in, upon, or by which any person or property is or may be transported.
Public parking spaces shall be classified according to the categories described below for purposes of identification, management, and enforcement. All public parking spaces in the Parking District shall be clearly delineated by painted stripes on the pavement and shall be clearly identified as to category by signage, pavement marking and/or other effective media.
A. 
Short-term parking. Short-term parking spaces are intended for the transient parking of vehicles of and by customers, clients, patrons or other visitors to the business establishments and residences served by the Parking District. Between the hours of 6:00 a.m. and 6:00 p.m. every day, no vehicle shall continuously park for a period of time in excess of three hours. Furthermore, there shall be no parking permitted on Westchester Avenue from 12:30 a.m. to 5:30 a.m. from November 1 to April 1.
B. 
Permit parking from 5:00 p.m. to 6:00 a.m. Permit parking in the designated spaces is intended for the overnight parking of vehicles belonging to and used by business establishments in the Parking District. Except to allow for the maintenance and/or cleaning of the parking facilities, and subject to the provision of § 101-6D below, these spaces may be continuously occupied during the permitted hours.
C. 
Un-signed spaces. The remaining un-signed spaces are available for use by employees, patrons and residents of the Business District and their guests.
The designation of parking spaces is indicated on the graphic diagram titled "Parking District #1, Scott's Corners Parking Plan," included as an attachment to this article.[1] The approved and adopted diagram shall be issued to appropriate agencies of the Town of Pound Ridge, including, without limitation, the management of the Parking District, the Police Department and the Town Court. Short-term parking and permit parking shall be physically identified as to their category by signage in accordance with the approved diagrams. The remaining un-signed spaces are available for use by employees, patrons and residents of the Business District and their guests, subject to § 101-3C above. No parking space shall be occupied by a vehicle except in accordance with the regulations applicable to the category designated on the approved and adopted diagrams.

A. 
A schedule for cleaning of all parking areas shall be established and filed in the office of the Town Clerk. At the scheduled times for cleaning, no parking shall be permitted. Vehicles entitled to park in the permit spaces shall be permitted instead to park overnight for the night of such cleaning only in nearby un-signed space.
B. 
For purposes of maintenance and/or repair of parking spaces or of adjoining real property, parking spaces may be closed to parking and temporarily occupied by personnel and equipment engaged in such activities. Such closed parking spaces shall be cordoned off from the balance of the facility of which they are part by tape, barricades or other separation as the Building Inspector or other appropriate official of the Town may deem necessary.
C. 
To facilitate the removal of snow during and after a snowstorm, vehicle owners will be responsible for the timely relocation of their vehicle, as necessary, to allow plowing to occur.
A. 
Officials of the Town of Pound Ridge have the right to suspend parking in some or all of the spaces in the Parking District at any time for any reason deemed appropriate for such action.
B. 
No vehicle shall be parked except within delineated parking spaces and in accordance with posted signs and/or pavement markings. Except as provided in Subsection C below, it shall be unlawful to park any vehicle in such a way that said vehicle shall not be entirely within the limits of the space so delineated.
C. 
Except for trucks parked in twenty-four-hour spaces, with a valid permit, no vehicle shall be parked which exceeds in length the parking space in which it is parked. Over-length vehicles parked in twenty-four-hour spaces shall be placed so as to minimize their encroachment into the driving lane that provides access to the parking spaces.
D. 
No vehicle shall be parked in any public parking space in the Parking District if it is unregistered and/or uninsured and/or if it is inoperable due to physical condition. Any vehicle which is visibly inoperable and which continues to occupy one or more parking spaces for a period of 72 hours or more within any portion of the Parking District will be considered to be an abandoned vehicle.
E. 
Except for the replacement of a flat tire, the emergency adding of fuel or similar unscheduled service, no vehicle shall be permitted to undergo repairs of any sort while parked in a public parking space.
Loading and unloading of merchandise and supplies to and from businesses in the Parking District shall be performed in locations that minimize the impact to the flow of traffic. Vehicles shall be permitted temporarily to stand in the access aisle, provided that the operator of said vehicle remains in the vicinity of the vehicle so that the vehicle may be moved to allow other vehicles to enter or exit parking spaces obstructed by the loading or unloading vehicle. The operator of such vehicle shall move it upon request. It shall be unlawful for such a vehicle to obstruct parking spaces for a period of time in excess of five minutes without the operator being available to move it upon request.
A. 
Storage of garbage shall only be permitted within dumpsters located within garbage enclosures, as designated by the Parking District.
B. 
The Parking District shall have final approval over the selection of a carting company to serve the district, to ensure that all dumpsters be located within the garbage enclosures. Said services will be selected through a public bidding process.
Parking permits shall be issued annually by the Pound Ridge Police Department for parking within the designated spaces upon presentation of a current lease agreement, as outlined herein.
A. 
For businesses, vehicles and/or trucks, a maximum of four spaces per thousand square feet. [For situations where employees arrive in the morning to use a business vehicle that has been parked overnight, employees will be required to park in those vacated spaces dining the day. Tandem parking is encouraged with multiple permits issued for the same space where appropriate (for example: 1A and 1B)].
B. 
The Parking District may issue additional permits for residents and business, if available. The availability of additional parking permits shall be reviewed by the Parking District annually and amended as deemed necessary.
C. 
Permits will only be issued to vehicles registered in the same name as appears on the lease agreement for the office and shall become invalid upon the expiration of said lease.
Parking is strictly prohibited in all handicapped zones (without a valid permit), crosswalks, fire lanes, in front of fire hydrants, and in other designated safety zones.
A. 
In conjunction with this article, all appropriate sections of the Vehicle and Traffic Law of New York State and the Town laws of the Town of Pound Ridge shall also be included in this section as pertains to enforcement. This shall include but is not limited to equipment violations, inspections, handicapped parking, and all other nonmoving violations of each of the mentioned laws. Where a violation occurs, enforcement shall be conducted by the Town of Pound Ridge Police Department or the New York State Police. Fines shall be levied in accordance with the applicable laws and as outlined in this article.
B. 
Failure to obey the regulations outlined in this article will result in the following fines, proportionally compounded for multiple infractions:
