A. 
For the purpose of this chapter, certain words and terms are defined as follows or as defined and used in Chapter 205, Zoning, of the Code of the Town of Union. Words used in the present tense include the future; the plural includes the singular; the word "lot" includes "plot"; and the word "shall" means mandatory.
B. 
As used in this chapter, the following terms shall have the meanings indicated:
ADT (AVERAGE DAILY TRAFFIC)
The average number of cars per day that pass over a given part.
APPLICANT
The owner(s) or owner's authorized agent of the land proposed to be subdivided.
APPLICATION
Application forms for sketch plan, preliminary plan and final plan. All applications are available at the Planning Department.
COMMISSIONER OF PUBLIC WORKS
The duly designated Commissioner of Public Works of the Town of Union.
CONTROLLED ACCESS POINT
A limited number of road cuts along a principal arterial, minor arterial, arterial connector or collector street.
ENGINEER
The person or persons who represent the Town of Union Engineering Department, including, but not limited to, the Commissioner of Public Works, Town Engineer, Deputy Commissioner of Public Works for Engineering or Assistant Engineer.

EROSION CONTROL PLAN
A detailed plan showing vegetative and structural measures needed to prevent erosion and sedimentation and a schedule for the implementation of such measures.
IMPROVEMENTS
Include, but are not limited to, the provision of a road gravel base, curbs and gutters, asphalt base coat, asphalt top coat, waterlines, sanitary sewers, storm sewers and drainage structures, streetlighting, fire call boxes, erosion control measures and such other improvements contained in the approved final plan, all to be provided by the subdivider. All such improvements shall adhere to the technical specifications contained in these regulations.[1]

LAND PARTITION
A division of land into four or fewer lots on existing streets. (See "subdivision" and § 181-5.)
LETTER OF CREDIT (PERFORMANCE BOND)
A letter of credit, bond, cash or assignment of securities posted by the subdivider to guarantee to the Town that the subdivider will construct or cause to be constructed, within a set period of time, the required public improvements and utilities that are an integral part of the final subdivision approval, in conformance with this chapter and with conditions set by the Planning Board.
LOT
A parcel of land occupied or capable of being occupied by a principal building(s) and accessory building(s).
MAINTENANCE BOND
A letter of credit, bond, cash or assignment of securities posted by the subdivider prior to the Town Board acceptance of the subdivision streets and utilities to guarantee to the Town for one year that any defective public improvements will be corrected by the subdivider within that period. The bond shall be set at 10% of the total cost of construction.
OFFICIAL MAP
The map adopted by the Town Board, under § 270 of the Town Law, showing the public streets, highways and parks and any amendments or additions adopted by the Town Board or additions resulting from the approval of subdivision plats by the Planning Board and the subsequent filing of such approved plats.
OFF SITE
Any premises not located within the area of the property to be subdivided which may be owned or not owned by the applicant.
PLAN, FINAL
The most detailed plan, showing the street construction details, utility construction plans, lot layout (plat), bearings and distances of all lots, grading and drainage plans and erosion control plans.
PLAN, PRELIMINARY
Includes topographic lines and features, proposed streets and grades, existing and proposed utilities, lot layout and size and the drainage system. It also shows the phases of the development, if it is proposed to be built in stages. If approved by the Planning Board, it provides the basis for proceeding with the preparation of the final plan.
PLAN, SKETCH
A conceptual plan that enables the Town to determine whether the proposed layout meets the general land development policies of the Town and to anticipate any problems associated with the development of the property. The sketch plan should show the general street configuration and lot layout, drainage, utilities and flood areas, if any.
PLAT, SUBDIVISION
A survey record of the subdivision or part thereof showing location of lots and street rights-of-way, their bearings and distances, easements and other pertinent data, as required.
RESERVE STRIP
A strip of land set aside as part of a subdivision, at the end of a temporary turnaround, in order to prevent the street from continuing through to adjoining property. The strip is not a building lot.
RESUBDIVISION
A change in the map of an approved or recorded subdivision plat, if such change affects any street layout shown on such map, creates additional lots or alters lot lines, where such lots were required by the Planning Board to be larger than the minimum lot size required by Chapter 205, Zoning. The process is also referred to as "replatting."
RUN-OF-BANK
Aggregate taken directly from natural deposits or manufactured for the specific use as backfill material. This includes, but is not limited to, Item 4 gravel, crusher-run gravel and one minus gravel. Gravel shall conform to Item 203.07, Select Granular Fill, of the New York State Department of Transportation Standard Specifications of latest issue.

STREET
A public or private thoroughfare, however designated, which affords legal access to abutting properties, including the entire area within the right-of-way.
STREET, ARTERIAL CONNECTOR
The arterial connector system interconnects with and augments the minor arterial system and provides service to trips of moderate length at a somewhat lower level of travel mobility than arterial roads. Total traffic volume usually exceeds 3,000 ADT.
STREET, COLLECTOR
Functions to conduct traffic between arterials, arterial connectors and/or activity centers. Collector streets are the principal traffic arteries within residential areas and carry relatively high volumes of traffic, up to 3,000 ADT.
STREET, CUL-DE-SAC
A street open at one end with the provision for a permanent turnaround at the other end.
STREET, INDUSTRIAL OR COMMERCIAL
A road which serves or is intended to serve industrial and/or commercial uses.
STREET, LOCAL
A short street or cul-de-sac. The primary function of a local street is to conduct traffic to and from dwelling units and other streets within the hierarchy. Usually there is no traffic between two streets of a higher classification on a local street. Traffic volume should not exceed 500 ADT.
STREET, MARGINAL ACCESS
A minor street which is parallel to and adjacent to arterial streets and highways and which provides access to abutting properties and protection from through traffic.
STREET, SUBCOLLECTOR
Provides frontage for access to lots and carries traffic to and from adjoining local streets. Traffic should have its origin or destination in the immediate neighborhood. Traffic volume should not exceed 1,000 ADT.
SUBDIVIDER
The person, partnership, corporation, owner or authorized agent legally responsible for the changing of property boundaries and for constructing or contracting to construct improvements on subdivided land.
SUBDIVISION INSPECTOR
A member of the Engineering Department whose responsibility is to make daily inspections of construction work within subdivisions as such work progresses.

SUBDIVISION OR SUBDIVIDE
The division of or dividing of any parcel of land into five or more lots, plots or other divisions of land along an existing street, or two or more lots, plots or other divisions of land along a proposed street or within the area incorporated in a Planning Board approved preliminary subdivision plan. (See "land partition.")

TOWN ATTORNEY
The duly designated Town Attorney of the Town of Union.
TOWN ENGINEER
The duly designated Engineer of the Town of Union.
TOWN PLANNING DIRECTOR
The duly designated Planning Director of the Town of Union.
TOWN STANDARDS
The engineering and building standards to be followed in the construction of a subdivision. The Town standards include the technical specifications included as Article IX and the detail drawings included at the end of this chapter.
ZONING ORDINANCE
The officially adopted Zoning Ordinance and Zoning Map of the Town of Union, as amended.[2]
