Town of West Seneca, NY Truck Routes

Trucks and commercial vehicles over five tons prohibited from using certain parks and certain thoroughfares. No person shall operate any truck or commercial vehicle exceeding five tons gross weight at any time upon or through any of the parks, parkways, park approaches and avenues described below, except that such vehicles may be operated thereon for the purpose of delivering or picking up materials or merchandise and/or the maintenance and repairs of public utilities and then only by entering such parks, parkways, park approaches and avenues at the intersection nearest the destination of the vehicle and proceeding thereon no farther than the nearest intersection thereafter.

Truck routes.

(1)

Pursuant to the authority contained in § 1660, Subdivisions (a)10 and 28, of the Vehicle and Traffic Laws of the State of New York, the Town of West Seneca hereby establishes a system of truck routes.

(2)

Any truck having a total combined gross weight of vehicles plus load in excess of five tons shall be excluded from all streets in said town, except those streets or parts of streets hereinafter listed or described which form a part of the system of truck routes upon which trucks are permitted to travel and operate, except that such vehicles may be operated thereon for the purpose of delivering or picking up materials or merchandise and/or the maintenance and repairs of public utilities. The total combined gross weight of the vehicle, plus load, shall be ascertained by computing the entire weight of the truck or vehicle plus load, or, in the event said vehicle is a tractor trailer combination, then by computing the entire weight of the tractor and trailer plus load.

All streets forming part of such truck route system shall be marked by conspicuous signs bearing the words "truck route" in letters not less than five inches in height, such signs to be spaced not more than 1,500 feet apart. In addition, conspicuous signs bearing lettering not less than five inches in height, such signs to be adequately illuminated between sunrise and sunset, or to be constructed of a reflecting material so as to be easily readable at night when lights from vehicle headlights fall upon such signs, shall be placed on each main highway entering the town, or at or near the point where such highway crosses or meets the boundary line of the town, indicating that trucks having a weight in excess of five tons, including load, are excluded from all streets within the town, except those streets designated as part of the authorized truck route system.

(4)

No person, firm or corporation shall drive or operate or cause to be driven or operated any excluded truck into, upon, along or through the streets of the town in violation of the provisions of this subsection.

(5)

The following listed streets or parts of streets, as herein designated, shall constitute the system of truck routes in the town:

(a)

Clinton Street (state).

(b)

Potters Road (state).

(c)

Seneca Street (county).

(d)

Ridge Road (county).

(e)

Center Road (county).
