This chapter is established pursuant to the
provisions of Article 7 of the Village Law of the State of New York.
This chapter is established to provide for the orderly growth and coordinated development of the Village of Westhampton Beach so as to assure the comfort and convenience, health, safety and general welfare of its people with consideration being given to the following: vehicular and pedestrian traffic; adequate drainage of surface water; encouraging the preservation of such natural resources as trees, woodlands, streams and ponds; providing adequate utility services and adequate and effective sewage disposal; and establishment of standards of subdivision design so as to provide suitable building sites for the land use so permitted by Chapter
197, Zoning of the Code of the Village of Westhampton Beach.
For the purpose of this chapter, certain words
used herein are defined as follows:
BOARD
The Planning Board of the Village of Westhampton Beach, the
official body authorized and appointed by the Village Board of the
Village of Westhampton Beach as provided by § 7-718 of Article
7 of the Village Law of the State of New York.
BOND
A.
PERFORMANCE BONDA bond furnished by the developer to guarantee that he will construct, or cause to be constructed, the required improvements. This bond shall not be released until all work has been completed.
B.
MAINTENANCE BONDA bond furnished by the developer to guarantee upkeep and the workmanship and materials of all required improvements for a period of one year from the date of release of the performance bond by the Village.
C.
UPKEEP BONDA bond, renewable yearly, which will take effect immediately following release of the maintenance bond by the Village, to be furnished by the developer to guarantee normal maintenance and upkeep on all required improvements until final acceptance by the Village.
EASEMENT
A grant for the use of land or an interest in the land to
the public, a corporation or particular persons for specified purposes.
HIGHWAY SYSTEM
All roads owned and maintained by the Village of Westhampton
Beach.
LOT
A portion of a subdivision or other parcel of land as a unit
for transfer of ownership or for development. "Lot" shall also mean
plot, parcel or site.
MEAN HIGH WATER (MHW)
For each location, the geographically nearest and most recent
determination by the United States Department of Commerce Coast and
Geodetic Survey and the listed elevation above MLW as shown in its
publications entitled "Tidal Bench Marks."
MEAN LOW WATER (MLW)
For each location, the geographically nearest and most recent
determination by the United States Department of Commerce Coast and
Geodetic Survey and 0.00 feet. All references shall be to the nearest
tidal bench mark listed.
PLAT
An accurate and complete survey of all properties within
a subdivision.
STREET
A way for vehicular traffic, whether designated as a street,
highway, thoroughfare, parkway, throughway, road, avenue, boulevard,
lane, place or however otherwise designated other than a service way
or driveway.
B.
MINOR STREETA street used primarily for access to abutting residential properties.
C.
LANEA street giving access to not more than six parcels of property used or to be used for residential purposes. "Lanes" may never become public highways and will only be allowed in exceptional cases.
SUBDIVISION
The division of any parcel of land into two or more parcels,
lots or sites, whether or not such division creates new streets, extends
existing streets or lies on existing approved streets.

VILLAGE ENGINEER
The official duly appointed by the Village Board of the Village
of Westhampton Beach and deputized by the Planning Board to provide
engineering services for such Board or, if there is no official, the
consulting engineer retained by the Planning Board.
