As used in this chapter, the following terms shall have the meanings indicated:
SWIMMING POOL
A structure, together with the enclosure, equipment and appurtenances used in conjunction therewith, intended for bathing, swimming or diving purposes, made of concrete, masonry, metal, plastic or other impervious materials, and provided with a recirculating and/or controlled water supply system.

Every outdoor swimming pool shall be provided with an enclosure in conformance with the New York State Fire Prevention and Building Code as it may from time to time be amended.

A. 
Swimming pool equipment, dry wells and appurtenances shall be located within the boundary lines of the lot within which the swimming pool is located and shall be located in conformance with the regulations as set forth in Chapter 197, Zoning.
B. 
A fence or enclosure may be located on an adjacent property, provided that the use of same complies with the requirements for enclosing the swimming pool. If such fence or enclosure is removed, a replacement fence or enclosure shall be constructed within 20 days of the removal and shall be located within the boundary lines of the lot within which the swimming pool is located.

Discharge of water from swimming pools shall be to an approved dry well buried at least five feet within the boundary lines of the lot within which the swimming pool is located. Directing discharge water from swimming pools to any point other than an approved dry well is prohibited.

Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
