The Town Board hereby finds that the regulation
of outdoor lighting in the Town of Yorktown is necessary to improve
or maintain nighttime public safety, utility and security; to improve
or preserve the aesthetic character of the community; and, also, that
such regulation is necessary to discourage the waste of electricity.
This chapter shall be applicable to all land
development, including but not limited to all new and amended commercial
and residential site plan applications and building permit applications
considering a change of use or tenant for an existing commercial structure.
This chapter is not intended to modify or repeal
any other existing ordinance, rule, regulation or other provision
of law. The requirements of this chapter are in addition to the requirements
of any other ordinance or provision of law, and where any provision
of this chapter conflicts with or imposes restrictions different from
those imposed by any other ordinance, rule, regulation or other provision
of law, whichever is more restrictive or imposes higher protective
standards for human health or the environment shall control.
If the provisions of any section, subsection,
paragraph, subdivision or clause of this chapter shall be adjudicated
invalid by a court of competent jurisdiction, such judgment shall
not affect or invalidate the remainder of any section, subsection,
paragraph, subdivision or clause of this chapter.
