In this chapter, the following definitions shall apply:
MINOR
Any person under the age of 18 years.
PARENT
Any natural parent of a minor, a guardian or any adult person 21 years of age or over responsible for the care and custody of a minor.
PUBLIC PLACE
Any public street, highway, road, alley, park, playground, public building or vacant lot.
REMAIN
To loiter, idle, wander, stroll or play in or upon.
A. 
No minor person shall be or remain upon any street, highway, alley, park or public place in the Borough of Media after the hour of 10:00 p.m. and before the hour of 5:00 a.m. the following day, as measured by the prevailing time, except that on Friday, Saturday and Sunday evenings and the eve and day of any holiday, as recognized and established by the Council of the Borough of Media, the restrictions shall apply at 11:00 p.m. and remain until 5:00 a.m. of the following day. Such restrictions shall be imposed unless the minor person is accompanied by his parent, guardian or is in the performance of employment for which he is receiving compensation.
B. 
The Mayor of the Borough of Media is authorized to issue to employers certifications of employment of minor persons, which certification shall be evidenced by the minor when such minor is in a public place during the hour of curfew restriction.
It shall be unlawful for any parent, guardian or other person having the legal care or custody of a person under the age of 18 years to allow or permit such minor person to be in or upon any of the streets, highways, alleys, parks or public places in the Borough of Media after the hours mentioned aforesaid in violation of § 139-2 hereof.

It shall be the duty of all policemen of the Borough of Media finding any minor person in or upon the public places of the Borough of Media as aforesaid to take the name of such minor and the name and address of the parent or guardian of the minor, to send the child home and to make a report of the same within eight hours to the Chief of Police. A written notice of the violation with due warning shall thereupon be served or caused to be served by the Chief of Police on the parent or guardian of the minor.

Nothing herein is intended to relieve the responsibility of the minor person from the enforcement of this chapter. Any minor person, a juvenile, may be charged with the violation of this chapter, which may result in reporting the violation to the juvenile authorities of Delaware County.
