That certain documents, three copies of which are on file in the office
of the Code Enforcement Officer and the Borough of Media, being marked and
designated as the International Mechanical Code, 1996 Edition, as published
by the International Code Council, be and is hereby adopted as the Code of
the Borough of Media for regulating the design, construction, quality of materials,
erection, installation, alteration, repair, location, relocation, replacement,
addition to, use or maintenance of mechanical systems in the Borough of Media
and providing for the issuance of permits and collection of fees therefore;
and each and all of the regulation, provisions, conditions and terms of such
International Mechanical Code, 1996 Edition, published by the International
Code Council, on file in the office of the Borough of Media are hereby referred
to, adopted and made a part hereof as if fully set out in this chapter.
The following sections are hereby revised:
Section 101.1 Insert: Borough of Media.

Section 106.5.2 Insert: Building Permit Fees found in Chapter 161, Fees, § 161-4A of the Media Code.

Section 106.5.3 Insert: 75%.

Section 108.4 Violation penalties. This section is deleted
in its entirety and replaced as follows:

Section 108.4 Any person, partnership or corporation who
shall violate a provision of this code or shall fail to comply with any of
the requirements thereof or who shall erect, install, alter or repair plumbing
work in violation of the approved construction documents or directive of the
Code Official, or of a permit or certificate issued under the provisions of
this code, upon being found liable therefore in a civil enforcement proceeding
commended by the municipality, pay a judgment of not more than $500 plus all
court costs, including reasonable attorney fees incurred by the municipality
as a result thereof.

Each day that a violation continues shall constitute a separate violation,
unless the District Justice determining that there has been a violation further
determines that there was a good faith basis for the person, partnership or
corporation violating the chapter to have believed that there was not such
a violation, in which event there shall be deemed to have been only one such
violation until the fifth day following the date of the determination of a
violation by the District Justice and thereafter each day that a violation
continues shall constitute a separate violation. All judgments, costs and
reasonable attorney fees collected for the violation of this chapter shall
be paid over to the municipality.
