No person, persons or entity shall operate or
conduct a public swimming pool within the Borough of Media except
in compliance with the rules and regulations of the Department of
Health, Commonwealth of Pennsylvania, pertaining to public swimming
pools.
Each person, persons or entity operating a public
swimming pool shall do so only upon license by the Borough of Media.
Application for the license and permit shall be on the forms provided
by the Board of Health of the Borough of Media, which shall set forth the name, address and business address
of the applicant and the names of the persons operating the public
swimming pool.
No permit and license shall be issued to any
person, persons or entities until the swimming pool has been inspected
and approved for public use. All such swimming pools shall be equipped
and operated in compliance with the rules and regulations of the Commonwealth
of Pennsylvania Department of Health relating to public swimming pools
and any other rules, regulations or requirements of the Board of Health
of the Borough of Media now in effect or hereinafter adopted pursuant
to this chapter within the scope of said regulations of the Commonwealth
of Pennsylvania. The name and address of the operator and number of
the operator's license and permit shall at all times be kept posted
prominently at the public swimming pool. Unless previously revoked
or suspended, all permits shall expire on May 30 of each year. Applications
for renewal of a permit shall be made prior to May 15 of each year
and shall be a renewal for a period of 12 months.

The licensing and inspection fee applicable
to each permit to operate a public swimming pool in the Borough of
Media shall be $250 per year. This inspection fee shall include all
inspections made during the year for which the license is applicable.
Any license issued pursuant to this chapter
may be revoked or suspended as a result of the violation of any of
the rules and regulations promulgated by the Department of Health
of the Commonwealth of Pennsylvania, which regulations are incorporated
herein, or by virtue of any rules and regulations in effect or hereinafter
adopted by the Media Board of Health pursuant to this chapter. Any
person aggrieved by any action of revocation or suspension of a license
may appeal to the Media Board of Health for a hearing to be conducted
according to law. The Board of Health may, after such a hearing, reinstate
the license or stay or set aside the order of revocation or suspension.

Any person, firm or corporation who or which
shall violate any of the provisions of this chapter shall, upon conviction,
be punishable by a fine not exceeding $1,000, plus costs of prosecution
and, in default of payment of such fine and costs, to imprisonment
for a period not exceeding 90 days.
