These rules, regulations and standards shall be considered the minimum requirements for the protection of the public health, safety and welfare of the citizens of the Township of Brick. Any action taken by the Planning Board under the terms of Part 4 of this chapter shall give primary consideration to the above-mentioned matters and to the welfare of the entire community. However, if the applicant or his agent can clearly demonstrate that, because of peculiar conditions pertaining to his land, the literal enforcement of one or more of these regulations is impractical or will exact undue hardship, the Planning Board may permit exceptions or waivers from the requirements for site plan approval as may be reasonable and within the general purpose and intent of the rules, regulations and standards established by Part 4 of this chapter.

Failure to comply with any provisions of Part 4 of this chapter shall be considered a violation of Part 4 and shall be punishable as provided in Chapter 1, § 1-15, General penalty. Each day of such violation's continuance shall be considered as a separate offense and shall be separately punishable. These penalties shall not be in the exclusive remedy available, and nothing in this Part 4 shall prevent the application for and the obtaining of injunctive relief.
