GENERAL REFERENCES

For the purpose of this article, the following definitions shall be
applicable:
A physical impairment which confines a person to a wheelchair, causes
a person to walk with difficulty or insecurity, affects the sight or hearing
to the extent that a person functioning in public areas is insecure or exposed
to danger, causes faulty coordination or reduces mobility, flexibility, coordination
and perceptiveness to the extent that facilities are needed to provide for
the safety of that person.
Any building, structure, facility or complex used by the general
public, including but not limited to theaters, concert halls, auditoriums,
museums, schools, libraries, recreation facilities, public transportation
terminals and stations, factories, office buildings, business establishments,
passenger vehicle service stations, shopping centers, hotels or motels and
public eating places constructed by any state, county or municipal governmental
agency or instrumentality or any private individual, partnership, association
or corporation, with the following exceptions: one- to four-family private
residences, warehouse storage areas and all buildings classified as hazardous
occupancies. As used herein, "hazardous occupancy" means the occupancy or
use of a building or structure or any portion thereof that involves highly
combustible, highly flammable or explosive material or which has inherent
characteristics that constitute a special fire hazard.

A special vehicle identification certificate and/or a license plate
issued by the Director of Motor Vehicles pursuant to N.J.S.A. 39:4-206.

From and after the effective date of this article, any individual, partnership,
association or corporation which owns any public building in the Township
of Brick shall provide reserved parking spaces for the physically handicapped
on any parking lot serving such public building in accordance with the following:
A.
A minimum of 1% of the total number of parking spaces,
but not less than two parking spaces, shall be provided in an area of the
parking lot which is most accessible and approximate to the public building
or buildings which the lot serves.

(1)
Each parking space or group of parking spaces designated
for vehicle parking by handicapped drivers or vehicles transporting the handicapped
will be posted with the proper sign as specified by the Manual on Uniform
Traffic Control Devices. In addition, any sign erected after the effective
date of this article shall include a separate penalty plate as set forth by
the New Jersey Department of Transportation.
(2)
Signs which were erected prior to the effective date
of this article shall be modified within 12 months after the effective date
to include the penalty information.
(3)
Single parking places may be posted with signs in the
center of the parking stall, or signs employing the appropriate arrow may
be placed on the side line of the parking stall. This technique may also be
used to sign multiple stalls located side by side.
C.
Each space shall be 12 feet wide to allow room for persons
in wheelchairs or on braces or crutches to get in and out of either side of
an automobile onto a level, paved surface suitable for wheeling and walking.
D.
Where possible, such spaces shall be located so that
persons in wheelchairs or using braces or crutches are not compelled to wheel
or walk behind parked cars.
E.
Curb ramps shall be provided to permit handicapped people
access from parking area to sidewalk.

A.
Any individual, partnership, association or corporation failing to provide parking spaces in accordance with the terms of this article and/or any operator of any motor vehicle who is not physically handicapped and who operates a motor vehicle in the absence of a physically handicapped person as a passenger in such motor vehicle and occupies a parking space reserved for the physically handicapped with such motor vehicle shall be subject to the penalties as provided in Chapter 1, § 1-15, General penalty.

B.
Any owner and/or operator of a motor vehicle who parks
in a space reserved for the physically handicapped and who does not display
a special vehicle identification certificate issued pursuant to N.J.S.A. 39:4-206,
regardless of whether the operator, owner or passenger in the vehicle is handicapped,
shall be subject to a fine of $250 for the first offense and for subsequent
offenses, a fine of at least $250 and up to 90 days' community service on
such terms and in such form as the court shall deem appropriate, or any combination
thereof.

No vehicle shall be parked on the property of Brick Township High School
located at 346 Chambers Bridge Road, Brick, New Jersey, also known as Lot
12, Block 701.39 or Brick Memorial High School located at 2001 Lanes Mill
Road, Brick, New Jersey, also known as Lot 2, Block 12-11, as shown on the
Tax Map of Brick Township, unless:
A.
The vehicle is parked within the permit parking area
as established by the Brick Township Board of Education, and has displayed
a current official Brick Township Board of Education permanent parking permit
on the rear side of the rear-view mirror in such a manner so it can be clearly
visible by a police officer or security personnel designated by the Board
of Education; or
B.
The vehicle falls under one of the following exemptions
to parking by permanent permit:
(1)
Pupils or visitors. A vehicle displaying a current parking
permit or temporary parking permit, provided that the operator of the vehicle
is a bona fide pupil or visitor to the grounds of Brick Township High School
or Brick Memorial High School and parks within the permit parking area. The
pupil or visitor's permit shall be displayed on the rear side of the rear-view
mirror of the vehicle in such a manner to be clearly visible by a police officer
or security personnel designated by the Board of Education.
(2)
Contractors, service and delivery vehicles. Contractors,
service and delivery vehicles bearing the name and addresses of a commercial
business may park without a permit within the permit parking area during the
time they are rendering service to the Board of Education.
(3)
Emergency and public utility vehicles. Emergency vehicles
and public utility vehicles may park within the permit parking areas during
the time they are rendering service or repairs to the Board of Education.
Application for parking permits under this article shall be made in
writing on forms available from the Brick Township Board of Education Business
Administrator. Permits shall be granted only under the following terms and
conditions:
A.
A permanent permit, valid for one school year, shall
be issued for a vehicle owned or principally operated by a person employed
by the Brick Township Board of Education. Said permanent permit shall be yellow
in color. Permanent permittees shall park anywhere on campus within parking
spaces demarcated by yellow lines.
B.
Pupil permits, valid for one school year, may be issued
to any pupil authorized by the Brick Township Board of Education Business
Administrator or his designee, attending Brick Township High School or Brick
Memorial High School. Pupil permits shall be white in color. Pupil permittees
shall only park within parking spaces demarcated by white lines.
C.
Visitor or temporary permits for a time not to exceed
24 hours may be issued for persons who are a bona fide guest(s) or visitor(s)
of any employee or of the Brick Township Board of Education. Said visitor
or temporary permittees shall only park within parking spaces demarcated by
white lines.
D.
The Brick Township Board of Education may establish fees
for issuing such parking permits. The Brick Township Board of Education Business
Administrator or his designee shall maintain appropriate records for all parking
permits and establish a procedure for renewal and replacement of parking permits
as well as all other administrative matters concerning the parking permits
required to effectuate permit parking authorized by this article.
A.
The Police Department of Brick Township or any Brick
Township Board of Education employee may make complaint in the Municipal Court
of the Township of Brick for any conduct in violation of this article.
B.
Any vehicle parked or standing in violation of this article
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and any police officer may provide for the removal of such vehicle.
The owner shall be responsible for the reasonable costs of removal and storage
which may result from such removal before regaining possession of the vehicle.
The provisions of this article shall only be effective between the hours
of 7:00 a.m. an 3:00 p.m. local time when school is in session.
