As used in this chapter, the following terms shall have the meanings
indicated:
AUTOBUS
Includes any automobile or motorbus, commonly called a "jitney,"
with a carrying capacity of not more than 13 passengers, operated under municipal
consent upon a route established wholly within the limits of a single municipality
and engaged in the business of carrying passengers for hire.
AUTOCAB
Includes any automobile or motorcar with a carrying
capacity of not more than nine passengers for hire, which is held out, announced
or advertised to operate or run or which is operating or run over any of the
streets or public highways of New Jersey and which is hired by charter or
for a particular contract or by the day, hour or other fixed period, or to
transfer passengers to a specified place or places, or which charges a fare
or price agreed upon in advance between the operator and the passenger.
The application for license shall be made in writing to the Clerk of
the Borough of Clementon. It shall contain the following information:
A. The full name and address of the owner and/or agent,
if any; if the applicant is a corporation, the names and addresses of the
officers and directors thereof, the registered office and the registered agent
or, if applicant is a partnership, the names and addresses of all partners.
B. The year, make, model, serial number and registration
number of each vehicle to be licensed.
C. The place of business and the location where the vehicles
are to be stored, repaired and/or maintained.
D. The place and location where the applicant will maintain
an office at which service of process may be made and where customers may
call and correspond for purposes of general information, rates, lost property
and other general inquiries.
E. The name of the insurance company and its address and
policy number, showing the limits of coverage required by this chapter.
F. A list of the applicant's operations in other municipalities.
G. Any criminal record information pertaining to the owner/operator
or driver; and a certification as to whether or not this type of license has
ever been revoked or suspended in any other municipality, including the details
thereof.
A driver's license must be secured before operating any of the vehicles
which are required to be licensed pursuant to this chapter. No such license
shall be issued to any person who is not competent to operate a motor vehicle
or who is not familiar with the traffic laws, rules, regulations and ordinances.
Such person must possess a bona fide New Jersey driver's license and must
be a citizen of the United States who has not been convicted of a crime involving
moral turpitude.

No license shall be issued under this chapter until the applicant has
filed with the Municipal Clerk proof of motor vehicle insurance issued by
a company duly licensed to transact business in the State of New Jersey. Such
policy must be in the sum of not less than $50,000 against loss by reason
of liability for damages on account of bodily injury or death suffered by
each person as a result of or by reason of the ownership, maintenance or use
of any of the licensed motor vehicles, and said insurance policy shall provide
for property damage insurance in the sum of not less than $25,000 for damages
arising therefrom. The operation of any vehicle licensed hereunder shall be
permitted only so long as the insurance policy shall remain in force. All
insurance policies issued hereunder shall name the Borough of Clementon as
an additional insured. Failure to maintain such insurance shall be deemed
sufficient cause for the revocation of said license.
All vehicles required to be licensed pursuant to this chapter must comply
with all the New Jersey motor vehicle laws, including those pertaining to
inspections. No licensed vehicles may be operated within the Borough of Clementon
unless and until the appropriate New Jersey inspection sticker is affixed
thereto.

Any person, firm or corporation violating any of the provisions of this
chapter shall, upon conviction thereof, pay a fine of $100. Each day such
violation is committed or permitted to continue shall constitute a separate
offense and shall be punishable as such under this chapter. In addition to
the fine, the offender shall be liable to the revocation of his or her license
issued pursuant to this chapter, depending upon the circumstances as found
by the Municipal Court Judge.
