The office of any person appointed by the Township Council to a board, committee, or other municipal agency, shall be deemed vacant if such person fails to attend and participate at meetings of such body for a period of six consecutive weeks or for three consecutive meetings, whichever shall be longer in duration, without being excused by a majority of the board membership. Such board or other agency may refuse to excuse only with respect to those failures to attend and participate which are not due to legitimate illness. In such event, such body shall notify the Township Council in writing of its determination. Township Council shall determine if the circumstances presented establish a basis for removal.

A. 
General. All powers of the Township and determination of all matters of policy shall be vested in the Township Council, except as otherwise provided by the Charter, general law or this chapter.
B. 
Board of Health. The legislative functions, powers and duties of a municipal board of health under Title 26 of the New Jersey Revised Statutes shall be vested in and exercised by the Township Council, and the powers of administrative direction and supervision shall be exercised by the Manager.
C. 
Local public agency. The Council shall be the local public agency and exercise all of the powers and duties provided by state and federal statutes.
D. 
Independent annual audit. The Council shall cause to be made an annual audit of the Township's accounts and financial transactions as required by law. Such annual audit shall be made by a registered municipal accountant of New Jersey, appointed by the Township Council.
E. 
Shade tree program. The Township Council shall maintain a suitable shade tree program for the Township of Maple Shade, said program to include, but not be limited to, the selection, planting, care, control, trimming and improvement of shade and ornamental trees and shrubbery upon and in the streets, highways, public places and parks within the Township.[1]

A. 
Selection. During the first week of January in each year, the date and time to be determined by Council, the members of the Council shall assemble at the usual place of meeting of the governing body of the municipality and organize and elect one of the Council members as Mayor and one as Deputy Mayor. The Mayor and Deputy Mayor shall be chosen by ballot by majority vote of all members of the Council. At the first initial organization meeting, if the members shall be unable to elect a Mayor within five ballots to be taken within two days of said organizational meeting, then the member who in the last election for members of the Council received the greatest number of votes shall be the Mayor. At every other organization meeting, if the members shall be unable to elect a Mayor within five ballots to be taken within two days of said organization meeting, then the member who in the last election for members of the Council received the greatest number of votes shall be Mayor. In the event of a deadlock at every other organization meeting, the eligible Council persons who shall be chosen on the basis of having received the greatest number of votes at the last election shall be limited to the two or three Council persons who were elected in the most recent election.

B. 
Powers and duties. The Mayor shall have such powers and duties as are vested in him or her by ordinance, the Charter and general law. The Mayor shall preside at all meetings of the Council and shall have a voice and vote in its proceedings. The Deputy shall act in place of the Mayor in the case of his or her absence or disability. In the absence of the Mayor and the Deputy Mayor, the Clerk shall call the Council to order and it shall thereupon elect a temporary chairman for the time being. Upon the arrival of the Mayor or Deputy Mayor, the temporary chairman shall immediately relinquish the chair upon the conclusion of the business immediately before the Council. All bonds, notes, deeds, contracts and written obligations of the Township shall be executed on its behalf by the Mayor, or in the event of his or her absence or inability to act, by the Deputy Mayor or such Council member as the Council shall designate to act as Mayor during his or her absence or disability. For purposes of this section, "absence" shall mean not physically present within 50 miles of the municipality. It shall be the duty of the Mayor or Deputy Mayor, whatever the case may be, to notify the Township Clerk of the date and time of his or her absence and estimated return.
