It is the intent of this article to establish
qualifications for the office of Deputy Supervisor of the Town of
Blooming Grove to assure that the function and operation of the Town
government will not be impaired by the Supervisor's death, illness
or other inability to perform the duties of office. The Town Board
finds and determines that it is in the best interest of the welfare
of the citizens and residents of the Town that the Deputy Supervisor
of the Town be a person elected to a legislative position by the electors
of the Town. Election to and participation in the business and affairs
of the Town Board is vital in assuring and providing the knowledge
necessary to perform the duties of the office of Deputy Supervisor
and responsiveness to the electors necessary to meet the needs and
interests of the residents and citizens of the Town. This article
is intended to be within the scope of powers available to the Board
as set forth in the 1982 Opinion of the State Comptroller No. 81 and
is not intended to curtail or eliminate the power of the Supervisor
to make such appointment pursuant to the Town Law § 42.
It shall be a qualification of the office of
Deputy Supervisor that any person appointed to such office shall be
a member of the Town Board of the Town of Blooming Grove. All other
provisions of Town Law § 42 shall remain applicable to said
office.
To the extent that this article is inconsistent
with Town Law § 42 it shall supersede such section pursuant
to Municipal Home Rule Law § 10.
