A. 
Membership and terms. There shall be a Town Planning Board consisting of five members appointed by the Town Board in accordance with § 271 of the state Town Law. All appointments and reappointments shall be made such that the terms of no two members shall expire at the end of the same calendar year. Appointments and reappointments, and the terms thereof, shall be made by resolution of the Town Board in a manner determined by the Town Board to accomplish the purpose of this chapter. Any person appointed to fill an unexpired term of a member shall be entitled to serve for the remainder of the unexpired term. Any member may be removed by the Town Board for cause after an opportunity for hearing.
B. 
Serve without compensation. Such members shall receive no payment for their services as members of the Board.
C. 
Designation of Chairman. The Chairman of the Planning Board shall be designated by the Town Board or, on failure to do so, shall be elected from and by its own members.
D. 
Experts and staff. The Planning Board shall have the power and authority to employ experts and a staff and to pay for their services and such other expenses as may be necessary and proper, not exceeding in all the appropriation that may be made for such Board. The Town Board retains the right to retain legal counsel for the Town to serve as legal counsel to the Town Planning Board or, in the alternative, the Town Board may appropriate budgetary funds for the Planning Board to retain legal counsel.
The Town Board may require members to complete training and continuing education courses in accordance with any local requirements for the training of such members. Such requirements may be established by resolution of the Town Board. Failure to complete any required training or continuing education courses shall be just cause for removal of a member.
The Planning Board may adopt rules and regulations in respect to procedure before it and in respect to any subject matter over which it has jurisdiction under this chapter or any other statute, after public hearing by the Planning Board and subject to the approval of the Town Board. Copies of all such rules and regulations and amendments thereto shall be filed and maintained in the office of the Town Clerk and Planning Board Clerk.
A. 
General provisions. The Planning Board shall have and exercise the powers and duties as follows, subject to and consistent with any other applicable statutes, local laws or other approvals:
(1) 
To prepare a comprehensive plan or amendments thereto, for discussion and possible adoption by the Town Board, for the development of the entire area of the Town of Blooming Grove, outside of the limits of the incorporated Village of Washingtonville and the Village of South Blooming Grove; and to make investigations and reports relating to the planning of the Town and its future growth and affording adequate facilities for the housing, transportation, distribution, comfort, convenience, safety, health and welfare of its population.
(2) 
To approve all plats showing any streets or highways within that part of the Town outside of the limits of the incorporated Village of Washingtonville and the Village of South Blooming Grove.
(3) 
To approve or disapprove changes in the lines of existing streets, highways or public areas shown on subdivision plats or maps filed in the County Clerk's office.
(4) 
To approve or disapprove the laying out of, closing off or abandonment of such streets, highways or public areas under and subject to the provisions of the Town and Highway Laws.
(5) 
Simultaneously with the approval of any such plat, to confirm and make changes in the zoning regulations applicable to the land, included in any such plat in accordance with the provisions of § 278 of the Town Law and amendments thereto.
B. 
Referrals by Town Board. The Planning Board shall also exercise all other powers conferred upon it by the provisions of the Town Law and shall pass upon all matters which may be referred to it from time to time by resolution of the Town Board. It shall conduct hearings and perform its duties in accordance with such procedure as provided in §§ 271 through 281 of the Town Law and acts amendatory thereof.
