In their interpretation and application, the provisions of this chapter shall be held to be the minimum adopted for the promotion of the public health, safety, comfort, convenience and general welfare. Except where specifically provided to the contrary, it is not intended by this chapter to repeal, abrogate, annul or in any way to impair or interfere with any rules, regulations or permits previously adopted or issued, or which shall be adopted or issued pursuant to law relating to the use of buildings, structures, shelter or premises. Nor is it intended by this chapter to interfere with or abrogate or annul any easements, covenants or other agreements between parties; provided, however, that where this chapter imposes a greater restriction upon the use of a building or premises or requires larger open space than are imposed or required by any other statute, local law, rule, regulation or permit or by any easement or agreement, the provisions of this chapter shall control.
A. 
Establishment. The Town Board, Planning Board, Board of Appeals, Architectural Review Board and any other agency or board affected by this chapter shall have the power to adopt rules and regulations subject to the provisions hereinbefore contained.
B. 
Any board may promulgate or propose rules and regulations either in the conduct of its affairs or as supplementary to this chapter.
C. 
Adoption. The rules or regulations intended to be adopted shall first be promulgated by the board or commission. Upon approval of a majority of its members, the same shall be transmitted by the Town Clerk, who shall include the same on a Town Board agenda within 60 days after receipt.
D. 
The Town Board shall, in its regular public session, approve, disapprove, modify or alter such or any portion of the proposed regulation, and, when adopted by resolution of the Town Board after public hearing, the same shall constitute a regulation of the promulgating board.
E. 
Amendments to any rule or regulation promulgated by a board and adopted by resolution of the Town Board may be amended or rescinded by resolution of the Town Board, with or without the concurrence of the promulgating board.
F. 
Violations. Violation of the requirement of any rule or regulation shall be a violation of this article, and such violation shall constitute a violation of this chapter.
