[Adopted 6-8-1959]
As used in this article, the following terms shall have the meanings indicated:
PARK
The East Rockaway Memorial Park.
A. 
The playing of football, hardball and/or softball games, or the throwing or batting of a hardball and or softball, in the park or any play area of the park is prohibited.

B. 
The playing of basketball, tennis, badminton or other organized activities or competitive sports in which two or more persons engage shall be prohibited on the first day of the week (Sunday), and basketball, tennis, badminton or other organized activities or competitive sports within the park shall be prohibited 1/2 hour before sunset and until 1/2 hour after sunrise.

C. 
The playing of golf or the driving or hitting of golf balls within the park is prohibited.
D. 
It shall be unlawful for any person or persons to fly, operate, control, navigate, propel any model plane, helicopter, flying saucer or any other device that is propelled through or in the air or above the surface of the ground by a gasoline motor or other type of propellant, other than an elastic band. The intent and purpose of this subsection is not to prohibit in any way the flying of kites or propeller-operated model airplanes whose motor power is derived from rubber bands or other elastic device.
E. 
The throwing and tossing of a Frisbee, disc or other similar missile is hereby prohibited in the park.

A. 
Any organized band or orchestra, choral Society or any representatives of any group or individuals, whether affiliated with any organization or association or not, shall not conduct any concerts, demonstrations, shows or any performances nor permit any individual group, band or representative to perform or conduct any performances or concerts of any kind or nature without making an application for a permit to conduct such performance, concert, show or demonstration and obtaining permission therefor from the Board of Trustees of the Village of East Rockaway.
B. 
The Board of Trustees of the Village of East Rockaway reserves unto itself the right to regulate the use of the band shell and areas of the park set aside for dancing or group activities and to prescribe conditions under which permission for the use of the band shell and the areas reserved for group activities, including dancing, block parties, etc., for which the Board shall consider among others the following standards:
(1) 
The health and welfare of the residents of the Village and particularly those adjacent to or living in the vicinity of the park.
(2) 
The type of activity for which a permit is sought.
(3) 
It shall prescribe reasonable safeguards and conditions for the protection of the health and welfare of the persons involved in the activity as well as spectators and other persons involved or participating in the activity for which the permit is requested.

No bonfires, grills, open flame cookers, gasoline stoves, fireplaces or other types of appliances or means of cooking outdoors shall be permitted or used in any portion of the park, except that the Board of Trustees may grant as a special permit to a recognized organization, association, veterans organization, Fire Department or fire company, civic association, church or temple the right to cook or grill food when the means and method of conducting such cooking or grilling has received written approval by the Fire Prevention Board or the Fire Council of the Village of East Rockaway.

The throwing of litter, rubbish, garbage, cans, bottles or other refuse in the park or the scattering of any kind of rubbish, garbage, refuse, cans, bottles, debris or waste material of any sort in the park shall be an unlawful act.

No person shall ride any bicycle, motorcycle or gasoline-driven vehicle of any kind or character in any portion of the park or any path, sidewalk, lane or playing area in said park, except that this section shall not prohibit or prevent automobiles or delivery trucks from entering the park under a permit of authority granted by the Board of Trustees.

The picking of flowers, breaking of limbs of trees, shrubs, plants or the defacing of any buildings, structures or parts thereof or damaging or breaking of any glass, railing or parts of any structures or buildings or the band shell or any part thereof, veterans' memorial, commemorative stones, markers, plaques, flagpoles, lighting posts, fixtures, fences, benches, backstop or backstops, swings, slides, playground equipment or any other improvements erected or constructed within the park is an unlawful act.

It shall be unlawful for any person or persons to climb upon the band shell, memorial monument, plaque, stone or any other structure or improvement within the park.

Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
