No person shall erect, hang, permit or allow
to be erected or hung any awning upon any building owned by him which
shall project over or upon any street, sidewalk or public place in
the Village unless such awning shall be at least seven feet above
such street, sidewalk or public place.

All awnings shall be constructed of metal frames
with a retracting device and the top thereof of fire-resistant canvas
or other suitable and nonflammable or fire-resistant fabric.
Wherever any awning shall appear to be unsafe or unsightly, an order or notice may be made in the same manner and subject to the same penalties as provided in Chapter
244, Signs, Article
I.

Any person committing an offense against any
provision of this article shall, upon conviction thereof, be guilty
of a violation pursuant to the Penal Law of the State of New York,
punishable by a fine not exceeding $250 or by imprisonment for a term
not exceeding 15 days, or by both such fine and imprisonment. The
continuation of an offense against the provisions of this article
shall constitute, for each day the offense is continued, a separate
and distinct offense hereunder.
