A.
Bonfires generally. No person shall burn or cause to be burned any grass, leaves, rubbish or any other material within the City in a manner whereby life or property is carelessly exposed to danger, nor shall any person burn or cause to be burned any grass, leaves, rubbish or any other material between sunset and sunrise, except in wire baskets or other fireproof receptacles with a proper cover.
B.
Fires on pavements. It shall be unlawful for any person to burn or cause to be burned any grass, leaves, rubbish or any other material of any kind or nature in or upon any paved street, sidewalk or other public place without a permit issued by the City Clerk upon approval of the City Engineer.
C.
Fires on private lands. No person shall kindle or maintain any bonfire or rubbish fire or authorize any such fire to be kindled or maintained on any private land unless:
(1)
The location is not less than 50 feet away from any structure and adequate provision is made to prevent fire from spreading to within 50 feet of any structure; and
(2)
Such fire is personally supervised until extinguished; or
(3)
The fire is contained in an approved waste burner with closed top, located safely not less than 15 feet from any structure.
D.
Fire Inspector and others may prohibit. The Council, Board of Fire Wardens, Chief of the Fire Department or Fire Inspector may prohibit any or all bonfires and outdoor rubbish fires when atmospheric conditions or local circumstances make such fires hazardous.
E.
No person shall kindle a fire upon the land of another without permission of the owner thereof or his agent.
