The purpose of this chapter is to establish and there is hereby established
a Publicity Fund in the accounts of the Village of Springville from which
expenditures may be made for the specific objects and purposes recited herein
and to which the taxes and other revenues of the village may be appropriated.
It is determined that certain publicly and privately sponsored parades,
festivals, exhibitions, shows, contests, farmers' markets, displays,
games, races and other similar events held within the village for the public
at large and which are designed to attract visitors to the area are desirable
for the general welfare of the village inhabitants and are otherwise desirable
for the benefit of trade within the village.
The Board of Trustees may in its discretion make appropriations to the
Publicity Fund hereby established either as part of the annual budget or at
any time from unanticipated revenues or from surplus amounts in other accounts.
Such publicity fund may not, however, be funded in any fiscal year in an amount
greater than $3,000, nor shall annual expenditures from such fund for all
qualified objects and purposes exceed the sum of $3,000 in any event.
No expenditure from the publicity fund shall be made to benefit any
single recipient or event in an amount greater than $1,000 in any one fiscal
year of the village.
Any resolution by the Board of Trustees authorizing the expenditure
of money from the publicity fund may contain special limitations upon the
recipient's use of any money to be paid by the village, and the payment
of any money so authorized shall be conditioned upon the recipient's
satisfactory compliance with the stated limitations.
No payment from the publicity fund shall be made by the village until
the qualifying event has actually occurred in its contemplated magnitude or
the Board of Trustees has determined that the benefit to be derived by the
village and its inhabitants has actually been received.
This chapter is not intended to create any right to funding in any person
or organization, nor is the Board of Trustees obliged to appropriate any money
to the publicity fund or to expend any amount from the publicity fund at any
time.
