West Hanover Township is empowered to regulate
land use activities that affect stormwater impacts, drainage and stormwater
management activities by the authority of the Act of October 4, 1978,
P.L. 864 (Act 167), the "Stormwater Management Act," and by the Act
of 1968, P.L. 805 (Act 247), the "Municipalities Planning Code," as
reenacted and amended.
A drainage/stormwater management (hereafter referred to as "D/SWM" plan) plan shall be submitted and approved by the Township prior to undertaking all regulated earth disturbance activities, subdivision and land developments and other applicable activities within the Township, in accordance with Chapter
168, Stormwater Management.

Compliance with Chapter
168, Stormwater Management, does not preclude the need to obtain other permits and approvals as required by West Hanover Township, Dauphin County, the Dauphin County Conservation District, the Commonwealth of Pennsylvania, the federal government and other agencies. Other permits and approvals may include zoning and building permits from the Township, an erosion and sedimentation pollution control plan, National Pollutant Discharge Elimination System permit (NPDES), water obstruction and encroachment permit, dam safety permit, submerged lands license agreement, Sections 401 and 404 of the Clean Water Act, and others. The most stringent of all pertinent requirements
shall apply. All stormwater management plans shall be recorded, either
as part of a subdivision or land development plan, or an as individual
document.

A request for a modification of stormwater management and planning requirements of Chapter
168, Stormwater Management, as part of a subdivision or land development application, or a zoning permit application, may be submitted, in writing, by the applicant to the Township setting forth the grounds and all facts relied upon by the applicant in accordance with Article
XI.
