The Township finds that the operation of such motorized recreational
vehicles has previously been conducted in a manner so as to disturb the peace,
quiet and tranquility of others and in a careless, reckless or negligent manner
so as to endanger or be likely to endanger the safety of others or the property
of others. This chapter proposes to regulate their use.
No person shall operate any recreational motorized vehicles, including
but not limited to snowmobiles; two-wheel vehicles known as minibikes, trail
bikes; motor scooters; three- or four-wheel motor vehicles known as all-terrain
vehicles (ATVs) and four-wheel motor vehicles known as go-carts, under the
following circumstances:
A. On the private property of another without the express
permission of the owner or occupant of the property.
B. On any public grounds or lands owned by the Township,
excluding streets, the use of which is expressly provided for by the New Jersey
statutes.
C. In a manner so as to create loud, unnecessary or unusual
noise so as to disturb or interfere with the peace and quiet of other persons.
D. In a careless, reckless or negligent manner so as to
endanger or be likely to endanger the safety or property of any person, including
the operator of the vehicle.
The terms and provisions of this chapter shall not be applicable to
police or other emergency vehicles, including but not limited to ambulances,
motorcycles, fire control vehicles and the like, or to motorized lawn mowers,
tractors or farm vehicles or construction equipment.
The Old Bridge Police Department is hereby authorized to confiscate
and impound any recreational motorized vehicle or ATV operated in a prohibited
area or in a prohibited manner in violation of the terms of this chapter.
The recreational motorized vehicle or ATV shall be returned to the owner thereof
upon payment of any fine imposed as a result of a violation of this chapter
or upon the direction of any court, except that a second or subsequent violation
shall result in the forfeiture of such vehicle.
Any person who violates any of the provisions of this chapter shall be, upon conviction, be subject to a minimum fine of $250 and a maximum penalty as set forth in Chapter
1, Article
II, Penalty.
