It is the purpose of this article to establish procedures for
water conservation when the Board of Public Works of the City of Lewes
determines that water consumption for all properties, both within
and without the City of Lewes, supplied by the Board of Public Works
is to be curtailed in order to preserve the public health and welfare
of the City of Lewes.
The Mayor of the City of Lewes shall declare voluntary water
conservation to be in effect for all water users served by the Board
of Public Works of the City of Lewes, both within and without the
City of Lewes, whenever the President of the Board of Public Works
recommends such voluntary water conservation to the Mayor because
the water supply or the capacity of the public water system is approaching
levels at which water rationing will be required to preserve the ability
of the Board of Public Works to deliver a necessary amount of water
to each water user.
The Mayor of the City of Lewes shall declare mandatory water
conservation to be in effect for all properties served by the Board
of Public Works of the City of Lewes, both within and without the
City of Lewes, whenever the President of the Board of Public Works
recommends such mandatory water conservation to the Mayor because
such restrictions are required in order that no water user served
by the Board of Public Works will be without water.
The Board of Public Works shall make weekly reports to the City
Manager while mandatory water conservation is in effect.
The Board of Public Works shall, from time to time, send, along
with the regular bills, an explanation of the regulations set out
in this article.
Any person, firm or corporation violating any provision of this
article shall be guilty of a misdemeanor and, upon conviction thereof,
shall be fined not less than $25 nor more than $200 and shall pay
the costs of prosecution. For the purposes of this article, a separate
offense shall be deemed to have been committed on each day during
or on which a violation occurs or continues.
The provisions of this article are separable, and the invalidity
of any clause or sentence of any section of this article shall not
affect the validity of the remainder of this article.
