For the purpose of this section, the following terms shall have the meanings designated, unless otherwise specified in this chapter:
CONTROLLED PARKING AREA
A land surface or structure owned, leased or rented by the Town of St. Michaels, designated for public parking.
PUBLIC PROPERTY
Any structure or land owned by the Town.
PUBLIC WAY
All streets, roads, highways, public thoroughfares, lanes and alleys.
SIDEWALK
That portion of a street right-of-way or a path abutting or parallel to a street right-of-way which is paved with concrete or similar material and intended specifically for pedestrian traffic.
A. 
Skateboarding, roller-skating, in-line skating and the use of recreational scooters and motorized recreational vehicles are prohibited on:
(1) 
All public sidewalks, by persons over the age of six.
(2) 
All private property unless the owner has granted permission.
(3) 
On all public property.
(4) 
On all controlled parking areas.
B. 
The restrictions above do not apply to juvenile vehicles such as tricycles, hot-wheels or similar apparatuses generally meant for younger children.
C. 
Skateboarding, roller-skating, in-line skating and the use of recreational scooters are permitted on other public ways, provided that said uses are continuous from origin to destination. No stunts or tricks are permitted on public ways, nor is the erection of paraphernalia to be used in the performance of stunts or tricks permitted.
D. 
[1]Motorized scooters, motorized recreational vehicles, dirt bikes, or other powered vehicles that cannot be driven legally on the roads in the State of Maryland may not be operated anywhere in the Town.

Editor’s Note: Former Subsection D, permitting skateboarding and in-line skating only at the Town skateboard park, was repealed 3-23-2016 by Ord. No. 471. This ordinance also redesignated former Subsections E and F as Subsections D and E, respectively.
E. 
Persons over six years of age may not ride bicycles on any public sidewalks.
This chapter shall be enforced by the St. Michaels Police Department.
A. 
Offenders under the age of 18 shall be addressed as follows:
(1) 
First offenders shall be issued a warning to cease the prohibited activity.
(2) 
Repeat offenders shall pay a fine of $25 and shall have their equipment confiscated until such fine is paid. The equipment shall be returned to a parent or guardian only.
B. 
Offenders age 18 and over shall be addressed as follows:
(1) 
First offenders shall be issued a warning to cease the prohibited activity.
(2) 
Second offenders shall pay a fine of $25 and shall have their equipment confiscated until such fine is paid.
(3) 
All repeat violations of this chapter shall be considered municipal infractions, the fines for which may be the maximum amount allowed by the Maryland Code, but shall not be less than $100.
C. 
Nothing contained herein shall prevent the Town from taking other such lawful action as is necessary to prevent or remedy any violations of this chapter.
