There is hereby created and established in the Department to which the Rent Control Board has been assigned the position of Rent Control Board Attorney.
The Rent Control Board Attorney shall be appointed by the Director of the Department to which the Rent Control Board is assigned for a term of one year.
The Attorney shall be a licensed attorney of the law admitted to the Bar of the State of New Jersey.
The annual salary range for said position shall be $20,000 to $35,000.
A. 
The duties of this position include the following:
(1) 
Being available and providing information to Rent Control Board personnel, landlords and tenants regarding West New York's Rent Control Ordinance[1] and any laws governing the implementation of that ordinance.

(2) 
Appearing at all regularly scheduled and special meetings of the Rent Leveling Board.
(3) 
Preparing all necessary correspondence and resolutions required by the office.
(4) 
Assisting in the coordination of any efforts of the Municipal Tenants Advocacy Attorney.
B. 
The Attorney shall be permitted to maintain a private law practice.
C. 
Said duties do not include the handling of any state, federal or municipal litigation involving the implementation of the Rent Leveling Ordinance in which the Rent Leveling Board or its members or employees are plaintiffs or defendants or in which the legal validity of the Rent Leveling Ordinance is challenged.
D. 
The governing body shall be authorized to enter into a professional services contract with the appointed attorney or any firm to which that attorney is associated with for the purpose of handling said litigation.
