No person within the limits of the Town of West
New York shall exhibit or show for any price, gain or reward any moving
picture show or performance, either by itself or in connection with
any other show, exhibition or performance, without first having obtained
a license for that purpose from the Board of Commissioners of the
Town of West New York.
The Board of Commissioners may, by resolution
adopted at any stated meeting, by the votes of a majority of those
present, license any person or persons to exhibit or show for price,
gain or reward a moving picture show or performance, either by itself
or in connection with any other show, exhibition or performance, at
a place within the limits of the town to be designated in the license.
All licenses granted under the provisions of this chapter shall expire
on the first day of June in each and every year.
Each applicant for a license shall present an
application in writing therefor at a stated meeting of the Board of
Commissioners. The application shall be signed by the applicant and
shall specify the street, building, structure or place where he proposes
and intends to conduct said moving picture show, which place, in case
a license shall be granted, shall be set forth in the license and
no license shall be authority to conduct such show or performance
at any other place than that designated in the license.
Every license issued under the provisions of
this chapter shall be sealed with the Corporate Seal of the town,
shall be signed by the Mayor of the town and attested by the Town
Clerk; every person licensed as aforesaid shall at all times keep
his license displayed in some conspicuous place in the building designated
in such license.
No license shall be assigned or transferred
without the previous consent of the Board of Commissioners; no transfer
shall be authorized by the Board of Commissioners except upon petition
therefor presented at a stated meeting of the Board, which petition
shall be of the form and substance as is herein required that applications
for licenses shall have and shall be accompanied by a transfer fee
of $10.

The Board of Commissioners may revoke or annul any license granted in case any person licensed shall violate any law of the state or any of the provisions of this chapter, and any persons violating any of the provisions of this chapter shall be liable to a penalty as provided for in Chapter
1, General Provisions, Article
I.

All suits, prosecutions and penalties for the
violation of any of the provisions of this chapter shall be had and
brought before and be imposed by the Judge of the Municipal Court.
