This chapter shall apply to all public parks and public park
approaches owned by the Town of Evans, unless otherwise delineated.
No activities shall be conducted and no persons
shall be allowed in Town parks and Town playgrounds without the prior
consent of the Town Board, except during the hours prescribed herein.

A. The Town Board of Evans hereby finds and declares
it to be in the public interest to regulate the hours of operation
of Town parks and playgrounds, to protect the public peace and control
the use and preservation of such Town-owned property as well as to
prevent undue disturbance to residents and to property owners in proximity
to such parks and playgrounds and relative thereto establishes the
following.
B. No activities shall be conducted and no persons shall
be allowed in Town parks and Town playgrounds except during the hours
prescribed herein or such other hours as may be allowed by special
permission of the Parks Crew Chief, who is authorized hereby to exercise
suitable discretion in the granting of such permission.
C. The hours of all Town parks and playgrounds shall
be from 7:00 a.m. to 10:00 p.m., April 1 through September 30 of each
year, and from 9:00 a.m. to 6:00 p.m., October 1 through March 31
of each year.
No vehicle of any kind or description shall be allowed to park
or be permitted to stand on any portion of any Town park areas other
than those areas specifically designated for parking.
Heavy vehicles or heavy-laden vehicles, except such as may be
used in the parks service, are prohibited from passing over the driveways
in the parks, and no person shall ride or drive any vehicle upon any
portion of the parks or its driveways in a reckless or careless manner
or at a rate of speed exceeding five miles per hour.
No motor vehicle shall enter the Evans Town Park unless the
motor vehicle displays a valid use permit issued by the Town of Evans,
except maintenance vehicles, delivery vehicles and all other vehicles
serving the Town, its agents or lessees on the premises of the Evans
Town Park.
Residents of the Town of Evans may obtain use permits for the
Evans Town Park at a fee to be determined from time to time by resolution
of the Town Board of the Town of Evans at a public meeting. Permits
may be obtained at the Evans Town Hall, 8787 Erie Road, Angola, New
York, and the Evans Town Park. Such permits shall be issued to and
used by the residents of Evans only.
A. Use permits are valid only when displayed on the front of the motor
vehicle or, wherever possible, as a preferential location, on the
front bumper or passenger side visor of said motor vehicle or such
other place authorized by the Town Clerk. The license registration
number of each vehicle shall be legibly written on said permit.
B. The permit shall be valid only for the calendar year issued.
No person shall have or give any musical, theatrical or other
entertainment, nor shall any parade, procession, public gathering
or meeting of any kind take place in any park or in any building on
the same except with prior permission of the Town Board, nor shall
any person solicit fares or beg or publicly solicit subscriptions
or make any oration, demonstration or address within the limits of
any park; unless prior special permission is obtained from the Town
Board.
No person shall deposit, dump, throw or place any earth, papers,
garbage or other rubbish, dust or similar material in or upon any
part of a park or park approach except in such receptacles as are
provided for same; nor shall any person place any sign, bulletin board
or advertising device of any kind whatsoever in the parks or upon
any building, fence, tree or other structure therein.
No person shall climb any tree or remove, disturb, break, cut
down, cut, injure, destroy, mutilate or deface, in any way, any part
of any park or any structure, monument, statue, fountain, wall, fence,
railing, sign, equipment, vehicle, bench, tree, shrub, plant, flower
or other property found therein or belonging to any park.
No person shall kindle, build, maintain or use a fire in any
park or park approach for any purpose.
No dogs, cats, horses or other pets/animals will be permitted
within any park, except the dog park.
The use of air guns, firearms, fireworks, firecrackers, torpedoes
or explosives of any kind within any park is prohibited, unless special
written permit therefor shall be given by the Town Board.
No food or refreshments of any kind, including alcoholic beverages,
shall be sold within the limits of any park or park approach without
the prior consent and/or license/permit of the Town Board.
No person under the age of 21 years shall consume any alcoholic
beverage or have in his/her possession any open container containing
an alcoholic beverage, with the intent to consume the same, within
the limits of any park or park approach.
No person shall throw, deposit, carry or use any glass bottle
or other glass container, bottle, jug, glass or mug, whether empty
or containing liquid of any kind, which receptacle is ordinarily used
or designed to contain beverages, within the limits of any park or
park approach.
Loud, boisterous, threatening or abusive, insulting or indecent
language or disorderly conduct or behavior or any act tending to a
breach of the public peace is prohibited.
No person shall dress or undress or make any similar preparations
for bathing within any park, except within the locker room or other
quarters furnished for that purpose by the Town.
No sand, gravel, stone or dirt shall be removed from any park
or adjoining beach.
No person shall fail, neglect or refuse to comply with any reasonable
order of a police and/or peace officer engaged in the discharge of
his/her duty.
Any person committing a violation of any provision
hereof shall be guilty of a violation punishable by a fine not exceeding
$250 or by imprisonment for a term not exceeding 10 days, or by both
such fine and imprisonment. The continuation of an offense against
the provisions of this chapter shall constitute, for each day the
offense is continued, a separate and distinct offense hereunder.
