The appointing power may lay off an employee
because of material change in duties or organization or shortage of
work or funds. Ten days before the effective date of layoff, the appointing
authority shall notify the Personnel Director of the intended action
and the reasons therefor, together with a statement certifying whether
or not the services of the employee have been satisfactory. A copy
of the notice shall be given to the employee affected.
Upon written application to the Personnel Director,
a permanent employee whose position has been terminated pursuant to
the above section shall have their name entered upon the eligible
list for appointment to a similar position. If more than one person
is laid off in a single class, the position of names shall be in inverse
order of lay off or in accordance with the employee's relative service
value to the Town as determined by work history, performance record
or other pertinent evidence.
An employee wishing to leave the service in
good standing shall file with the supervising official at least two
weeks before leaving the service, a written resignation stating the
effective date and reasons for leaving.
With the approval of the appointing power, an
employee who has resigned with good record may be reinstated within
two years to their former position, if vacant, or to a vacant position
in the same class.
