As used in this chapter, the following terms
shall have the meanings indicated:
GARAGE SALE
The sale, or offering for sale, trade or other consideration,
of items, goods or merchandise on property located in a residential
zoning district. The term "garage sale" shall include yard sales,
carport sales, driveway sales, flea markets and rummage and estate
sales. Auctions are not included in the definition and are not permitted
in residential zoning districts.
PERSON
Anyone acting for himself or herself, or for another person,
or for any firm, partnership, corporation, organization or other entity.
It shall be unlawful for any person to hold,
manage, sponsor or otherwise conduct a garage sale without first obtaining
a permit from the Department of Community Improvement. There shall
be no fee charged for a permit. The permit must be obtained prior
to the commencement of the sale and shall be prominently displayed
on the premises at all times during the sale. The permit shall contain
the following information and shall be signed and sworn to by the
applicant:
A. Full name and address of the applicant.
B. Location at which the sale is to be held.
C. Date or dates of the proposed sale.
D. Date or dates of any garage sale held by the applicant
or on the proposed premises during the previous 12 months.
E. A statement that the property to be offered for sale
is owned by the applicant or his/her family, that the items to be
offered for sale are all previously owned personal property, that
no property or items to be offered for sale have been or will be acquired
by consignment, and that no property or items have been or will be
acquired for the purpose of resale.
The Director of the Department of Community Improvement has the authority to issue a single garage sale permit to a representative of a neighborhood association or other group of residents to hold an annual garage sale in their neighborhood. Upon issuance of a permit for a group garage sale, the individual participants shall not be required to obtain individual permits. Participation in an annual neighborhood garage sale shall not count as one of the two sales permitted pursuant to §
111-3E.
Violations of this chapter shall be punished in accordance with §
1-16 of the Code of Ordinances.
