A.
The City Solicitor shall be appointed by the City Council and shall be appointed for a term of one year, beginning on the first day of January of the year of appointment, and shall serve until his or her successor has been appointed and qualified. The Solicitor shall be an attorney at law of the State of New Jersey, but need not be a resident nor maintain an office in the City of Brigantine.
B.
The City Solicitor shall receive such salary and other compensation as is authorized by the Annual Salary Ordinance of the City of Brigantine.[1] In addition thereto, the Council or the Manager may from time to time assign such additional work to the Solicitor according to a professional services contract to be approved by the Council.
C.
The City Solicitor shall have such powers and perform such duties as are provided for the office of City Solicitor by general law or ordinances of the City of Brigantine. The Solicitor shall give all legal counsel and advise where required by the Manager, the Mayor, the Council, or any member thereof, or the Clerk and shall in general serve as the legal advisor to the Council and Manager on all matters of City business. In furtherance of such general duties, the City Solicitor shall:
(1)
Represent the City in all judicial and administrative proceedings in which the City of any or its officers or agencies may be a part or have an interest.
(2)
Draft or approve as to form and sufficiency all legal documents, contracts, deeds, ordinances and resolutions made, executed or adopted by or on behalf of the City.
(3)
Conduct appeals from orders, decisions or judgments affecting any interest of the City as may be determined to be necessary or desirable, as directed by the Mayor, the Manager or the Council.
(4)
Have the power to enter into any agreement, compromise or settlement of any litigation, subject to the approval of Council.
(5)
Render opinions, in writing, upon any question of law submitted for such purpose by the Manager or Council or any member thereof.
(6)
Perform such duties as may be necessary to provide legal counsel to the Manager or the Council in the administration of City affairs.
(7)
Supervise and direct the work of such additional attorneys and legal-technical and legal-professional assistants as the Council may authorize for special or regular employment.
(8)
Deliver to the Manger such products of work, reports, memoranda and City property as are generated for and use on behalf of the City, except, however, that the files and materials generated by the Attorney for his or her own use in the preparation of work for the City shall remain the property of the Attorney.
(9)
Act as and for the City Prosecutor in the temporary absence of the Assistant Solicitor assigned for such purpose.
D.
The Solicitor may not designate a substitute to perform duties of the Solicitor, except for brief absences, notice of which shall be reasonably given to the Manager and the Council in advance of such absence.
