A. 
No person shall park any vehicle in any of the ocean front parking areas owned and maintained by the City of Brigantine for the time period beginning with the Friday of Memorial Day weekend and ending with the Monday of Labor Day weekend unless such person obtains an electronic daily or seasonal parking permit for such vehicle. During the time period from Memorial Day weekend to Labor Day weekend when permit parking is required, no permit shall be necessary to park in ocean front municipal lots between the hours of 6:00 p.m. and 8:00 a.m.
B. 
A daily or seasonal parking permit for parking in the municipal lots during the time period when permit parking is required can be secured upon arrival at a municipal lot using the pay-to-park Park Mobile™ payment system. Once paid for, parking for the registered vehicle shall be valid in all parking lots associated with the mobile-pay purchase and the license plate associated with that registered vehicle shall serve as the proof of payment for that vehicle for parking enforcement purposes.
C. 
Payment for daily parking shall be made daily through use of the City's pay-to-park Park Mobile™ payment system utilizing a mobile cellular device. Daily parking spaces cannot be reserved or paid for in advance. Payment for seasonal parking shall be made prior to the commencement of the Friday of Memorial Day weekend through use of same payment system utilizing a mobile cellular device.
D. 
Notwithstanding anything to the contrary set forth above, no vehicle may be parked in any municipal parking area between 6:00 p.m. and 6:00 a.m. for a period of time in excess of four hours. No oversized vehicle that occupies more than one parking space or extends further then the length of any parking space is permitted to be parked in any municipal parking area. Nothing herein shall apply to any vehicles owned by the City of Brigantine and used in conjunction with official business of the City of Brigantine. The City Manager of the City of Brigantine may authorize parking of said oversized vehicles in emergency or other situations.
E. 
No person shall park any vehicle in the municipal parking lot located at 13th Street and Brigantine Avenue for a consecutive time period in excess of two hours.
F. 
No commercial vehicle or trailers of any type may be parked at the municipal parking lot located at 14th Street with the exception of jitneys which have been assigned a space at said municipal lot.
G. 
There is hereby established municipal parking lots at Block 4102, Lot 2 (501 Casa Drive), and Block 4703, Lot 16 (530 Casa Drive). No commercial vehicle or trailers of any type shall be parked at these municipal parking lots. No oversize vehicle that occupies more than one parking space or extends farther than the length of any parking space is permitted to be parked in these municipal parking lots. No person or other entity shall park any vehicle for a consecutive time period in excess of 24 hours at these municipal parking lots.

Identification tags shall be sold by the Fire Department or the Beach Patrol Office of the City of Brigantine. Identification tags shall be sold commencing the first business day of each year.

The identification tags shall be such tags as are designated by the City Manager. Identification tags will expire on December 31 of the year in which they are issued, and the registration fee shall be as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule, per annum, when purchased prior to June 1 and as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule, per annum, when purchased on or subsequent to June 1. Daily permits shall be as set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule. All parking shall be available on a first come first served basis.

A. 
This article shall be enforced by members of the Police Department, auxiliary police and the Beach Patrol of the City of Brigantine.
B. 
Notwithstanding anything to the contrary contained herein, any vehicle with a legally issued and displayed handicap license plate or emblem shall be allowed to park in the designated handicap spaces in any municipal parking lot or parking area without paying for and obtaining a municipal identification tag or parking permit.

Any person who shall be convicted of a violation of any of the provisions hereof shall be punished for each offense by a fine not to exceed $1,000 or by imprisonment for a term not to exceed 90 days, or both.

Permanent vehicle parking shall be limited only to the owner, lessee, tenant or occupant of a residence or dwelling in the City of Brigantine, residing in such zones where the parking of such vehicles, except during the course of the activity for which they are customarily used, is prohibited. Temporary vehicle parking shall be limited to those vehicles or pieces of equipment being utilized in the City of Brigantine, on a temporary basis and only for the term of such work. Permanent parking is limited to one vehicle. The lot shall be for the parking of commercial vehicles, and the parking of boats and/or boat trailers on said lot shall be prohibited.

Identification tags shall be issued only to those persons who have completed an application form as established by the City Manager or his designee and have made payment of a fee as set forth in Chapter 210, Mercantile Businesses, Article II, Fee Schedule. Temporary identification tags may be issued upon completion of the appropriate application and payment of fee and may not be used in lieu of permanent tags. All permits shall expire on December 31 of the year in which they were issued, and no individual or entity shall be entitled to a pro rata reimbursement for any portion of the calendar year.

The Superintendent of the Department of Public Works or his designee shall be the issuing authority for the tags described above. Application shall be made on a form designated for such purpose and shall require the applicant to provide necessary information, including the name, address, birthdate, social security or employer identification number and telephone number of applicant. In addition, proof of current registration, inspection and general liability insurance shall be provided. Where such vehicle is to be used by the employees of the applicant, proof of current worker's compensation insurance shall also be required.
Persons making application and parking such vehicles shall agree, further, to hold the City of Brigantine harmless and free of loss and expense for damage to any vehicle or other property contained therein. In addition, applicants shall hold the City harmless as to damage, loss or expense arising out of use of the City's premises or the operation of the vehicle. Persons using the City's premises shall keep their vehicles in a clean and serviceable condition and shall store no equipment or property on the City's grounds, other than that which is fully enclosed and secured within or on the vehicle. Vehicles shall not be used for the storage of hazardous substances or materials or for the accumulation of waste. Open vehicles shall not contain any materials, other than equipment items properly secured thereon. Upon request, the City's representative shall be supplied with a set of operable keys for the vehicle, to be kept in the City's possession during the term of storage or parking on the City's premises. The City, however, will assume no responsibility for the movement or safekeeping of vehicles, and it is the responsibility of the applicant to remove such vehicles in the event of storm or other natural calamity.

The City may deny any application based upon failure to comply with the application requirements or based upon the City's need for space in the municipal parking facility. A request to remove such vehicle for violation will be made, upon written or telephonic notice to the applicant at the address listed on the application, and in normal cases the owner shall be given five working days to remove the vehicle. In an emergent situation, the City may request immediate removal of the vehicle. Placement of a notice to remove the vehicle or parking citation shall be deemed proper notice to the owner, where the owner does not respond to the direct notice given in the fashion stated in this section.

Failure to remove vehicles, upon the expiration of permission as granted by this application, or upon expiration of current registration, shall entitle the City to have such vehicle removed at the expense of the owner, and the owner shall pay all costs, including storage fees. An owner may be cited for any other violation of this article or for any violations of the ordinances or regulations in effect in the City of Brigantine.

In addition to the cost of removal, the owner of such vehicle may be charged with violation of this article and, upon conviction thereof, pay a fine of at least $25 per day, but not more than $1,250 or be imprisoned for a term not to exceed 90 days, or both in the discretion of the Municipal Court Judge. Each day of noncompliance can be considered an additional violation. In addition, the Municipal Court can award costs payable to the City of Brigantine for any costs incurred by the City of Brigantine in the enforcement of this article or for the moving, storage or securing of any vehicle by the City of Brigantine pursuant hereto.

The parking of any trucks, box trucks, motor homes, or other commercial vehicles of any kind having a gross weight in excess of 8,100 pounds or a cargo capacity in excess of one ton, net, shall be prohibited from being parked on the streets of the City of Brigantine between the hours of 11:00 p.m. and 6:00 a.m., unless being actively used in commercial activity or emergency during said time. This section shall not apply to any jitneys, the owners of which have entered into an agreement with the City of Brigantine to help provide evacuation services in the case of flooding or other emergency or natural disaster.
