All licenses issued hereunder shall be subdivided and classified as follows and shall be issued only subject to the payment, as required by the law, of the license fees set forth hereafter.
A. 
Plenary retail consumption license. The holder of this license shall be entitled, subject to all rules and regulations governing the same, to sell for consumption in licensed premises any alcoholic beverages by the glass or other open receptacle and also to sell all alcoholic beverages in original containers for consumption off the licensed premises. The annual fee for this license shall be as established by ordinance of the Township of Monroe.

B. 
Seasonal retail consumption license. The holder of this license shall be entitled, subject to all rules and regulations governing the same, to sell for consumption in licensed premises any alcoholic beverages by the glass or other open receptacle and also to sell all alcoholic beverages in original containers for the consumption off the licensed premises during the term for which such license is issued. The fee for this license shall be as set forth in Chapter 74, Fees. Seasonal retail consumption licenses shall be limited to three in number, provided that the limitation on plenary retail consumption licenses has not been reached, and if such limitation has been reached, then no seasonal retail consumption licenses shall be granted.

C. 
Plenary retail distribution license. The holder of this license shall be entitled, subject to all rules and regulations governing the same, to sell any alcoholic beverages for consumption off the licensed premises, but only in the original container. The annual fee for this license shall be as established by ordinance of the Township of Monroe. Licenses of this class shall be limited to one in number.
D. 
Club license. Club licenses shall be issued only to such corporations, associations and organizations as are operated solely for benevolent, charitable, fraternal, social, religious, recreational, athletic or similar purposes and not for private gain, and such licenses shall be subject to the qualifications, conditions and restrictions imposed by the State Commissioner of Alcoholic Beverage Control. Not more than four club licenses shall be issued and outstanding in the Township of Monroe at the same time. The fee for a club license shall be as established by ordinance of the Township of Monroe, and the holder of such license shall be entitled, subject to rules and regulations, to sell only to bona fide club members and their guests alcoholic beverages intended for immediate consumption on the licensed premises.
E. 
Limited retail distribution license. No limited retail distribution license of any character or description shall be granted within the Township of Monroe.
F. 
Specific license fees.

(1) 
Plenary retail consumption license fees shall be as set forth in Chapter 74, Fees.
(2) 
Plenary retail consumption with broad package privilege shall be as set forth in Chapter 74, Fees.
(3) 
Plenary retail distribution license fees shall be as set forth in Chapter 74, Fees.
(4) 
Club license fees shall be as set forth in Chapter 74, Fees.
(5) 
Fees for person-to-person and place-to-place transfers shall be set forth in Chapter 74, Fees.

G. 
Hotel/motel license. This license may be issued to a person or business entity who operates a hotel or motel containing at least 100 guest sleeping rooms. The annual fee for this license shall be as established by ordinance of the Township of Monroe. Licenses of this class shall be unlimited.

A. 
No new plenary retail consumption or seasonal retail consumption licenses shall be issued in the Township of Monroe unless and until the combined total number of such licenses existing in the municipality is fewer than one for each 3,000 of its population, as shown by the last then-preceding federal census.
B. 
No new plenary retail distribution license shall be issued in the Township of Monroe unless and until the number of such licenses existing is fewer than one for each 7,500 of its population, as shown by the last then-preceding federal census.
A. 
Whenever the Township Council of the Township of Monroe authorizes the issuance of a new plenary retail consumption license, it shall, by resolution, cause to be published a notice of the proposed issuance and state that applications for the new license or licenses shall be accepted by the Monroe Township Council.
B. 
Notice.
(1) 
The notice shall specify a time and date after which no further applications will be accepted. The notice shall be published in a newspaper circulating generally in the municipality, and in all official newspapers of the Township of Monroe, by not less than two insertions, one week apart, the second of which shall be made not less than 30 days prior to the time and date specified in the notice as the time and date after which no further applications will be accepted.
(2) 
The notice shall also specify that any prospective bidder shall apply and qualify for a license prior to the sale, that proof of qualification for a license shall be included with the bid and that all bids shall be sealed.
(3) 
The notice shall include the minimum bid that is acceptable, any special requirements for prospective licenses and general conditions of sale, including a statement that the municipality reserves the right to reject all bids where the highest bid is not accepted.
(4) 
The notice shall specify the time and place at which bids shall be received and opened and that all prospective bidders shall qualify not later than five business days prior to the opening of the bids.
(5) 
The Monroe Township Council shall, five days prior to the opening of the bids, publicly announce those applicants who meet the qualifications for bidding, as fixed by law, rules, regulations and resolutions.
(6) 
No bid shall be opened from or on behalf of any prospective bidder who does not qualify.
(7) 
No bid shall be considered which does not contain proof of qualification.
C. 
Issuance of license after publication of notice. The Township of Monroe shall not be required to authorize the issuance of any additional licenses with respect to the notice that has been published, but in any case in which such license or licenses have not been issued within six months after the closing time and date for acceptance of applications specified in the notice, no such license or licenses shall be issued without again complying with this notice provision.
D. 
Issuance to highest bidder; public sale; qualifications.
(1) 
Whenever the Township Council of the Township of Monroe authorizes the issuance of an additional license or licenses by resolution, it may authorize that the license or licenses be issued to the highest qualified bidder; therefore, the Monroe Township Council shall conduct a public sale for such purpose.
(2) 
The Township Council, by resolution, may prescribe qualifications for prospective bidders, including the requirement that a licensee, as a condition of the award of the license, operate a restaurant, public accommodation or other facility, not contrary or inconsistent with any law, rule or regulation.
E. 
Issuance of license or rejection of all bids; postponement or cancellation of sale; disposition of funds.
(1) 
Upon the conclusion of the sale by the Township of Monroe, a license shall be issued to the highest qualified bidder upon the payment of the bid price and the license fee, or it shall reject all bids if the highest bid is not accepted.
(2) 
A sale may be postponed or canceled at any time prior to the opening of the bids.
(3) 
Funds derived from the conduct of a sale shall be remitted to the Municipal Treasurer for the general use of the municipality.
