GENERAL REFERENCES

As used in this article, the following terms shall have the meanings indicated:
BICYCLE
A two-wheeled device upon which a person is or may be transported and that is propelled solely by human power.
BICYCLE PATH
A way other than a roadway or sidewalk that is designated as a bicycle path by § 100-2 hereof.
OPERATE
The use, putting into action or causing to function of a bicycle or tricycle by a person mounted thereon or having custody thereof.
TRICYCLE
A three-wheeled device upon which a person is or may be transported and that is propelled solely by human power.

There is hereby established within the township a bicycle path, which path is described as follows: an eight-foot-wide bituminous concrete surface running along the previous railroad right-of-way from Blue Bell Road to the Monroe Township line (Glassboro), a distance of approximately five miles, as shown on Plans of Monroe Township, Gloucester County Bikeway System, filed with the State Department of Transportation and the Township Clerk.
A. 
Every person operating any permitted vehicle upon the bicycle path shall operate said vehicle at a safe speed and with due regard for the safety of the rider and of other persons and property.
B. 
Every person operating a permitted vehicle upon the bicycle path shall ride as near to the right side of the bicycle path as practicable, exercising due care when passing a stationary object or person or one proceeding in the same direction.
C. 
Every person operating a permitted vehicle upon the bicycle path shall give reasonable warning by an audible signal before passing a stationary person or a person proceeding in the same direction.
D. 
Every person operating a permitted vehicle upon the bicycle path shall remain at a safe distance behind any other permitted vehicle being operated upon said path and shall not follow too closely.

It shall be unlawful for any person, entity, firm or corporation using the municipal bicycle path to either perform or permit to be performed any of the following acts:
A. 
No person shall use or operate upon the bicycle path any bicycle or vehicle which is or may be driven by motor, including but not necessarily limited to two-wheeled motor vehicles known as minibicycles, trail bicycles, motor scooters or "motorized bicycles" as defined in Chapter 250 of the Laws of 1975.[1]

B. 
No person shall cast, throw or deposit in any manner on or about the bicycle path any kind of dirt, rubbish, waste article, thing or substance whatsoever, whether solid or liquid.
C. 
Willfully mark, deface, displace or remove any building, bridges, tables, benches, railings, paving or paving material, waterlines or other public utilities or parts or appurtenances thereof, signs, notices or placards, whether temporary or permanent, monuments, stakes, posts or other boundary markers or other structures or equipment, facilities or municipal bicycle path property or appurtenances whatsoever, either real or personal.
D. 
Throw, discharge or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream, bay or other body of water in or adjacent to the bicycle path or any tributary, stream, storm sewer, or drain flowing into such waters any substance, matter or thing, liquid or solid, which will or may result in the pollution and/or littering of said waterways.
E. 
Bring in or dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waster, garbage or refuse or other trash. No such refuse or trash shall be placed in any waters in or contiguous to the municipal bicycle path, or shall be left anywhere on the grounds thereof, but shall be placed in the proper receptacles where these are provided. Where receptacles are not so provided, all such rubbish or waste shall be carried away from the park or playground by the person responsible for its presence and properly disposed of elsewhere.
F. 
Damage, cut, carve, transplant or remove any tree or plant or injure the bark or pick the flowers or seeds of any tree or plant; nor shall anyone attach any rope, wire, or other contrivance to any tree or plant. A person shall not dig in or otherwise disturb grass areas or in any other way injure or impair the natural beauty or usefulness of any area.
G. 
As to wild animals, no one shall hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or throw stones or any missiles at or give or offer any poisonous foods to any animal, reptile, bird or the eggs of same.
H. 
Bring in or upon, have brought in or upon or cause to be brought in or upon the bicycle path or the grounds thereof any alcoholic beverage or illegal drugs, nor sell, purchase, consume, drink any alcoholic beverage or illegal drugs at any time in the park.
I. 
Bring in or cause to be brought in or have in his or her possession or set off or otherwise cause to be exploded, discharged or burned any firecracker, torpedo, rocket or other fireworks or explosive or flammable material or discharge them or throw them into any area of the bicycle path upon the land adjacent thereto. Notwithstanding the foregoing, the bicycle path or facilities thereon may be used for a scheduled fireworks program under the sole direction of the Monroe Township Department of Community Affairs.
J. 
Build or attempt to build a fire except in a fireplace designated and constructed for such purposes and under such regulations as may be adopted from time to time by the Township Council or Division of Parks and Recreation. No person shall drop, throw, or otherwise scatter lighted matches, burning cigars or cigarettes, tobacco, or any other flammable material within the bicycle path.
K. 
Engage in any disorderly conduct or behavior tending to cause a breach of the public peace. No person shall disturb or otherwise interfere with any other person or group of persons occupying any area or engaging in any organized activity.
L. 
Sell or offer for sale any object or merchandise or any other thing within the parks or playgrounds or place any other equipment or apparatus within the parks or playgrounds, except by permit or as may be permitted by the rules and regulations, in accordance with the requirements set forth in this Code.
M. 
Remove or open permanent or temporary barriers, signs, directionals, gates or fences.
N. 
Picnic or lunch in a place other than those designated for that purpose.
O. 
Endanger the safety of any person by any conduct or act.
P. 
Prevent any person from using the bicycle path or any of its facilities or interfere with such use in compliance with this chapter and the rules applicable to such use.
Q. 
Fail to obey, nor shall any person interfere with, an officer in the proper performance of his duties.
R. 
Leave bicycles, except in designated areas.
S. 
Ride a horse, except in areas designated for such use.
T. 
Gamble.
U. 
Sleep on park benches.
V. 
Solicit alms or contributions, except with written permission of the Mayor.
W. 
Carry firearms or other weapons.
X. 
Bring any concession trucks or otherwise sell any food or beverage in bicycle path areas.

It shall be unlawful for any person to be in or upon any of the municipal bicycle paths of Monroe Township after one hour following sunset until sunrise, unless prior written approval is obtained from the Division of Parks and Recreation. In the event that any portion is lighted for nighttime use, hours of use shall be extended to 11:00 p.m.

Any person who violates or fails to comply with any of the provisions of this article shall, upon conviction thereof, be punished by the payment of a fine of not more than $1,000 or imprisonment for not more than 90 days, or both.
