As used in this chapter, the following terms shall have the meanings indicated:
PERSON
An individual, partnership, corporation, cooperative, association or any other legal entity.
VENDING MACHINE
Any mechanical device that displays cigarettes or tobacco products to which the consumer may purchase one of the tobacco products by the insertion of currency or a credit card.

It shall be unlawful for any person to sell or permit to be sold or offered to sell any tobacco products to any individual without first requesting and examining identification from the purchaser positively establishing the purchaser's age of 21 years of age or older. It shall be unlawful to sell or permit to be sold any tobacco product to any person under 21 years of age. Whenever a police officer or any citizen believes that there exists a violation of this chapter, he or she may file a complaint, in Municipal Court, within 30 days after discovery of the alleged violation.
Any person convicted of violating an provision of this chapter shall be subject to a fine of not less than $100 and not more than $1,000 for each offense, and and/or community service not to exceed 30 days.
