It shall be unlawful for any person to:
A. Loiter in or upon any street or public place or in
or about any public building so as to interfere with the free and
unobstructed use thereof by the public.
B. Utter or make any loud, indecent, abusive or offensive
language or noise in or upon any street or public place or in or about
any public building.
C. Engage in any game of chance for money or other valuable
thing in or upon any public street or public place.
D. Make any indecent exposure or exhibition of any kind
or commit any disturbance or breach of peace in or upon any street,
avenue or place, public or private, in the Township.
E. Disturb, by any violent, obscene, abusive or threatening
language or disorderly or indecent behavior of any kind, any lawful
congregation or assembly of any kind or description in any place or
building within the Township.
No person shall make or assist in making any
riot, noise or disturbance in any house, shop, store or any other
place, public or private, within the Township.
No person shall keep or maintain a disorderly
house or a house of ill fame in the Township.
No person shall allow or permit his or her house,
shop, store or other place to be used, frequented or resorted to by
riotous or disorderly persons, prostitutes, gamblers, vagrants or
mendicants.

A. Except as otherwise permitted pursuant to Chapter
276 of the Township Code, Sidewalk Cafes, no person shall drink, consume or cause to be consumed any alcoholic beverage; or have in his or her possession any unsealed alcoholic beverage container with an alcoholic beverage therein upon any public street, sidewalk, right-of-way, avenue, pathway, park, playground, recreation area or any other public place or upon any land owned or occupied by the Township of Montclair or upon outdoor facilities owned or operated by the Board of Education of the Township of Montclair.

B. Nothing in this section shall be construed to prevent or prohibit the otherwise lawful consumption of alcoholic beverages at a block party for which a permit has been granted pursuant to Chapter
222, Parades and Processions, of the Code of the Township of Montclair, or at an event for which a social affair permit or a petition for extension of licensed premises has been consented to by the Township and approved by the Division of Alcoholic Beverage Control, State of New Jersey.

No person other than those connected with or
employed upon the railroad who are acting within the scope of their
employment shall enter upon the right-of-way of any railroad or come
into contact with any equipment, machinery, wires or rolling stock
of any railroad. This section shall not prohibit a passenger for hire
from utilizing those parts of a railroad particularly intended for
passenger use nor shall it prohibit a person from using a crossing
established by the railroad.

Any person who violates any provision of this
chapter shall, upon conviction thereof, be punished by a fine not
exceeding $2,000, imprisonment in the county/municipal jail for a
term not exceeding 90 days, or a period of community service not exceeding
90 days, or any combination thereof as determined by the Municipal
Court Judge. Each day on which a violation of an ordinance exists
shall be considered a separate and distinct violation and shall be
subject to imposition of a separate penalty for each day of the violation
as the Municipal Court Judge may determine.
