Fire prevention and building code administration — See Ch. 58.
In furtherance of the enforcement of the Building Code of New York State, the administration of which code has been delegated to the Town of Albion New York, and to further provide for the health, safety and welfare of its residents, the Town of Albion hereby adopts a rental permit system to provide for having maintenance inspections to insure adequate housing standards for residents who live in rental housing units.
Owners and lessors, or their respective agents of rental housing units and owners of all rental apartments within the Town of Albion, shall within one year after the effective date of this chapter or within 60 days from the date of mailing of registration forms by the Code Enforcement Officer, whichever occurs first, file with the Code Enforcement Official, on registration form available from the Code Enforcement Official, the following information:
A. 
The names and addresses of the owner and lessor, and or their respective agents, upon whom violation orders may be served;
B. 
A description of the property, by street and number or otherwise, as will enable the Code Enforcement Official to locate the same; and
C. 
Such other appropriate information as may be requested, including, but not limited to, number of units, number and type of rooms, together with a schematic diagram showing the typical floor layout of the units and rooms with appropriate designations and identifications.
Rental permits, issued pursuant to satisfactory completion of a housing maintenance inspection, shall remain in effect for one year or until there is a change in tenancy, which ever occurs first. Annual inspections must be conducted before the end of the calendar month in which the expiring permit was issued.
No rental unit may be occupied until and unless a rental permit has been issued and is in force. The Code Enforcement Officer shall have the right to apply to a court of appropriate jurisdiction to enjoin the use and occupancy of any rental apartment subject to this chapter for which a rental permit has not been granted.
An owner, lessor or their respective agent who refused to grant access to an apartment to the Code Enforcement Officer shall be liable for all costs incurred by the Town of Albion to receive an administrative search warrant for the purpose of making said inspection.
Violation of this chapter shall be punishable by a fine not to exceed $250.
This chapter shall take effect immediately upon filing with the Secretary of State.
